I got t-boned by a not insured car today when I was making a left turn at yellow turning red light. A car I didn't see coming hit the passenger side back door (most impact) since I was already making the turn. We exchanged information and have police came for report and found out that the other party has no insurance.
I also just did some research and found out that I am most possibly be the at-fault party in this case so I am worried about what I should do. Is it really most of the case?
I tried to ask around lawyers and they seem don't want to touch the case at all because the other party is not insured, what should I do?
Now the right side of the car is basically wracked and I don't have full coverage to help. Some people even said that I don't need to report to my insurance company because I have only liability coverage...
The police said that the report will come to me within a week or so. Do I wait for the report or any action I should take?
Wonder if anyone can share your experience and give me some suggestion. Thanks in advance.

Ah, see, you made the left turn in front of someone going straight, through that light.
That means, you ARE at fault. Yes, it's really most of the case. The lawyers don't want to work for free. Plus, it's a losing case, if you're trying to sue the other person.
If you don't have collision on your policy, which you don't, there isn't any coverage for your car. But you should probably report this to your insurance company, as the other driver will probably be looking for YOU to pay for HER damages. |

If you weren't injured there is no reason to involve a lawyer. There will be no dispute about the cost of the damage. If you have full coverage just report the accident to your insurance company and let them handle everything from there. They will pay for the damage to your car less deductible or total it. The other party will probably have their car impounded and lose it for having no insurance but that doesn't do you any good. I'd bet the impound fees plus damage will be more than his car is worth so the car will probably be sold for scrap.
If you don't have full coverage you will have to sue the other party in court. Small claims court if the damage is below your states maximum for small claims, or superior court if it is above the limit. You can sue without a lawyer. The court clerk will assist you in filing the necessary paperwork.
Unfortunately in the end you probably won't get a dime because most people who drive without insurance don't have any assets worth going after. He'll probably just lose his license and then continue drive without a license or insurance. |

It doesn't matter what kind of insurance you have.... Report this to your insurance company ASAP. Because you have only liability, repairs won't be made to your car unless the 2 insurance companies decide the other guy was at fault. One thing is certain. Your car WILL NOT be repaired until/unless you report this to your insurance company |

Call your insurance company to find out if you are covered under UMPD (Uninsured Motorists Property Damage). You can have your damages repaired under that coverage. Also, even if you don't believe you are covered for that, file a claim anyway. It will protect you in the event you are sued by the other party. As far as liability, that needs to be determined by a licensed adjuster- just because the other party is uninsured, it doesn't mean you are 'at fault.' Also, don't wait for the police report before you call your carrier, they can order a report from the reporting agency. |
