I don't think there is anything you can do once the insurance decides what they are going to do with it. Did you sign any paperwork accepting that? If you didn't I would fight the insurance company in your settlement. If you did, you are screwed.

My mom's friend had totaled a car that got fixed and it was in 3 other major accidents, one involving hitting a pedestrian! So I totally agree with your wife on the bad Kharma.

Try going back to the mechanic and find out why the car wasn't totaled.

I'm in the same boat....only that the collision company has started repair work on my car which has complicated my situation. This is my first wreck but I've learnt plenty....here's how I think your situation would play out, only if your wife hasn't signed any authorization for the mechanic to start working on the car.

First off call the mechanic and halt any repair work and tell him you will let him know what you want done. Also while you are at it, get him to give you the estimate of what its going to cost to have the car fixed. Then contact your insurance company and ask them what the cash value of your car is (I suggest you also try to find it yourself, kbb.com is a good site). Then ask them at what % of the cash value do they total a car. My agency told me they total it at 75%..some do so at 80%. If the cost to repair your car has not reached that %, then the car will not be totalled. Your option would be for the insurance to pay you the estimated repair cost minus your deductable and you get to keep the car. The mechanic will also hit you with cost of his own if the car is not totaled and you decide not to fix it. He'll probably charge you for towing, storage, and also for any labor done so far and either for the parts, or the restocking fee he will be charged when he returns the unused parts he had purchased to fix your car.

If you own the car free and clear, and the repair cost is high enough, you might be able to get the down payment for another car. It gets complicated if you have a loan, you are upside down and have no gap insurance. If you are not comfortable with the mechanic, get a third party to assess the damages....hope everything works out in your favor.

Make sure insurance is paying 100% for everything done to fix your car. I know what I crashed my Firebird my insurance gave me the option to either have it totaled and accept their $10,000 check or they'd pay for a portion of the damages (but it was going to cost far more than $10,000 to fix it).

you can put your car in neutral or park, wutever and put a block, or sumthing heavy on the gas, the accelerator and get back from it. try this for 10 min, it will sound like ur car is severly constapated, but ur engine and things will get messed up!!!!!, or it can blow up too, if you leave it on the accelarator for too long
