Last year november 2007, i was snapped passing a red light, a week or two after I got a letter from the police etc telling me to furnish the details of the driver etc etc i left it for 1 month and they sent me a reminder, after which I filled in my details and sent it to them.
Later on they sent me a letter of a offer, pay £60 and 3 points on your license or go to court, well I never filled in this form coz I was waiting for them to send me a reminder after which I will surely pay and incurr the 3 points penaulty. Well this never occured, its been nearly 6 months since that letter.
Will I get prosecuted?? How comes they havent gotten back to me in 6 months?? If I get a letter saying to go to court, couldnt I just say I never recieved that letter and would have payed the fine and recieved the points since I willing furnished my details in the first place??
My insurance is due for renewal next month. Technically I havent got 3 points on my license since its not registered?

They will prosecute you and the fine will rise to the court hearing expenses - normally about £250 + your original £60.
what makes you think you are owed a reminder ?
They told you "pay up" or "court". They didn't say "we'll be sending you anoher reminder"
You've made your choice, and that choice was "court"
You could try and say "I never recieved that letter" if you want to. They will probably add contempt to the list - taking your orignal £60 to about £750 - good job !!
You are fully aware you are under an "NIP" and have to tell your insurance. The premium wil be higher than if you'd just paid the original fine as the case isn't settled yet. So, you've probably added another £75 to your insurance premium just because you didn't pay the original fine and the case is still open
if you don'tdisclose this to your insurance, you can add £1000 to your original £60 for driving without valid insurance.
Keep going, if you get to £10,000 you'll get into the newspaper, the title will not be flattering.
On the plus side, you've got a bit to go before they lock you up.

The letter offering you the opportunity to take a £60 fine and three points says on it that if you do not reply it will automaticaly go to court. At court the fine can be up to £1000 and you can get between 3 and 6 points for this offence. Typicaly at court the penalty is £250 and 4 points.
You should have taken the opportunity when it was presented. The court date can be any time up to six years from the date of the last letter. |

This could be an oversight on their part. However, you should not have waited for a reminder. It is possible in my opinion that you will still be contacted when it comes to light.
If it were me I would re-new my insurance and if you have,to plead ignorance if it becomes necessary. Whilst it could turn serious, I think the answer above is taking it to the extreme |

Why didn't you pay it? You say the letter syas pay the fine and take the points or go to court - so doesn't that mean you're about to get a letter with a court date? Although you may not physically have the 3 points on your license, the DVLA may have a note of it already. |

It is better to declare all when making a new insurrance poilcy. If they found out about your situation and you failed to declare anything, then it could declare your policy null and void. |

Your insurer will ask if you have been prosecuted for any motoring offences or have any prosecutions outstanding. You have a prosecution outstanding as you are currently waiting to go to mags court.
They wont send a reminder about the fixed penalty option, you had 28 days to take that choice. If you get a letter saying go to mags court and you don't turn up they will issue a warrant for your arrest. You then get to spend the night in the Police cells (weekend if you're unlucky) and taken to mags court next morning in whatever you happen to be wearing at the time of your arrest. If you are found guilty of failing to stop at a red light your fine and points will be at least the same as the fixed penalty but probably higher, the points will also be from the date of conviction not the date of the offence so will be with you for much longer. If you know you are guilty its usually best to take the fixed penalty option.
Technically you don't have 3 points on your licence yet as you have not been convicted but you do have an outstanding prosecution which your insurance company will need to know about if you are to be properly covered.
Might be worth chasing up when your hearing is in order to get it over and done with as unfortunately it is unlikely to just go away. |

I don't know what state your in but in my state we have the points already on there and they can get taken away.
Anyway, why don't you just pay it and not worry about it anymore. Be smart about it, from now on at least. |

Technically,you don't have any points on your licence,I personally,would stop worrying and get on with my life.
I wouldn't bother telling the insurance company about what might happen in the future either. |
