Have a slight bump , i want to put through insurance, other party doesn't?

Just a hypothethical sitaution.- i am curious as someone i know has had a bump! No damage to my car but the person i bumped has a dent. I want to go through the insurance but they dont (they are insured). what would happen if anything?

It's up to you. You could ask to see the quote for repairs and agree to meet that figure personally, or you could insist he deals with your insurers.

Is this the one you just asked about, where the lad has a massive excess? If the cost is going to be close to that amount I'd deal with it personally, and preserve the insurance record.

Depends how much damage is done - I mean in money terms. You will lose any no claim bonus you may have accrued if you go to insurance. It may be cheaper to pay damage to other car. Remember also that you probably have an excess. In other words you may have to pay the first £x anyway.
If one car isn't damaged at all then it can't have done that much damage to the other one, can it?

Go thru your insurance. What is only a little dent now can turn into major repairs when you agree to pay

If you told your insurance they they would tell HIS insurance and they may decline his cover, or bump up his premiums..

it is after all material evidence of his (possibly lax) standards of driving. They have a legal right to know about all incidents, whether claimed or not.

This is what you carry insurance for! It should not matter one bit to the other person that you are using your insurance. The only reason I can think of that they would not want to (since you are the one at fault!) is that it's possible they were driving on a suspended license, or do not have one to begin with, or, they just want you to give them cash so they can pocket the money without fixing the car. Use your insurance--it protects you. What if they claim injuries 'down the road'?

if you hit him--go to ins. it would be nice to pay him off and forget about it but if he blows you in to the cops its a hit and run. take no chances.

They cannot force you to settle it yourself without going through your insurance company. They may want you to for several reasons.They may not be insured after all, or could be driving illegally. Any accident will reflect in their renewal premium whether it was their fault or not, which could be a legitimate reason for them not wanting to involve their insurance company. However they are legally required to give you your insurance details. If they do not, they are breaking the law. You really have nothing to lose. I would tell them that you cannot afford to pay for the damage yourself and have no choice but to go through your insurance. Ask them for their details. If they insist that they don't want to or won't give you their details, then just don't pay up. They won't have a leg to stand on. If this is the case then you should also make a police report to say they won't give their details, just to protect yourself.

You can't insist that the other driver goes through their insurance company i.e. they can pay the claim themselves. You can point out that they do have a duty to report the incident to their insurers though and they do have a duty to provide insurance details to you.

It is your responsibility to provide your insurance with details of all accidents. In Calif., if the damage to either party is $750.00 or greater it must also be reported to DMV. However, if you agree to make a deal with the other party, GET IT IN WRITING. Remember one thing, one way or the other, always exchange complete information of both parties and get an accident report. Never admit fault at the scean, to the other party nor to the officer making the accident report. The officer will make that determination in the report.
