He's taking my car! What should I do?

I bought a car with my EX boyfriend and we put both of our names on the registration because I haven't had my license long enough so insurance would be high for me and he wanted to help me out by making me pay less. Anyways, we broke up (I lived with him) and now he's threatening to take away my car that I paid for! We haven't gotten the actual title in yet (in the mail) and he says he will forge my signature when the title does come in and put the car completely under his name! He's being a total *** and I don't know what to do. How do I prove to whoever it is that I need to prove to that the car is originally mine ?

When you paid for the car, you paid using checks or credit card, where there is a bank statement documenting your payments.

Since the car is in both your names, you cannot prove that it is totally yours. However, you have the proof that you made the payments, and your signature is on that.

Is the car paid for outright, or is there some bank loan? Whose name is the bank loan in?

I think you first need to go to the police and make a statement. Take along your proof of financial payments. Later when confronted by the police, he may well change his story and deny he ever said what you quoted.

Second, have you been to the post office to arrange that your mail be forwarded to your new address. There is a change of address kit you can pick up to make sure all the places that normally send you mail, now know your new address.

Take him to court....... if he forges your signature, you can press charges. that's illegal.

It depends on how you did the title when you bought it, and it all depends on "And" and "Or"

If the title says Jane Doe and Barney Rubble, it will take both signatures to make any changes, and if he forges your name he can be arrested for auto theft. If it says Jane Doe or Barney Rubble, either of you can do whatever you want without the knowledge or permission of the other.

You don't prove the car was originally yours because you put his name on it to defraud the insurance company, and now it's coming back to haunt you.

If the car is in both of your names, you need to find a legal way to get it in your name. He can try to forge your signature, but forgery for a vehicle (I believe over $1000) is a felony and you can get him arrested for it if he tries to do that.

You may have to take him to small claims court, or consult with an attorney (the first meeting may be inexpensive to ask what your options are).

Bummer. Because it's HIS. His name is on the title, right?

The car is NOT originally yours. It's half yours, and half his. It doesn't MATTER who made the payments. Legally, whoever has their name on the title, owns the car.

However, he can't just "forge your name" to sign the car over to him - it has to be NOTARIZED, that signature. So NEITHER of you can sell this car without the permission - and cooperation - of the other one.

If you think he HAS forged your name, you call the police and press charges against him.

And I hope you never, ever, ever go into a "joint financial venture" with someone you aren't married to. Because if all he does is steal your half of the car, you got off easy. It could be MUCH worse - like he takes his half of the car, and TRASHES it - because deliberate damage by the owner of the car is NOT covered by insurance. So you'd be SOL - no car, no coverage.

Ha!! My advice is to LET him go ahead and forge your name on a vehicle title. Two years in the slammer licking grape jelly out of a lifer's butt crack will teach him to be stupid. Honestly though, you need to contact a lawyer PRIOR to recieving the title. They can walk you through this in case he does try something stupid.

You should have registered your car in your name only. You tried to save money at first and now you end with no car.

If both of your names are on the registration, and he signs your name, he can go to jail. Call your local DMV and explain what may happen. They can put a flag on the title that will prevent him from being able to transfer the title into his name only, without you being present.

You cant really do anything unless your EX boyfriend signs the car over to you. You should take him to court and bring the papers that show YOU have made the payments. Otherwise you are not in a good position.

If he tries to take it, you may need to file a Small Claims against him. Do you have proof where you made the payments on it? If so, be sure to take that info to court with you.

I don't know if there is a way. If your name is on it as well as his, then he should not be able to sell it without your consent. Call the MVD and see if they have any ideas. The title shouldn't come in the mail, the leinholder should send a piece of paper telling you that you have to go to the MVD to retrieve the title, in which case you can call and put a non-release on it.
