Help!!! I am being sued because my insurance co. didn't pay!?

I got into an accident last May and it was my fault. WhenI filed the claim with the insurance co. I told them I was making a left hand turn in the intersection when the pther party hit me. I was barley going 5 miles an hour and he was speeding because my car was totaled yet his was not.

I was clearly legally in the wrong since I was making the left turn even though he hit me. All this information was told to my insurance co. I had liability so I wasn't looking for any money for my car. But they told me that they didn't pay the claim filed by the other company because I said he hit me! Now the other company is suing me!

Am I going to have to pay? Isn't that what I had insurance for? Shouldn't they pay the claim even though I said he hit me since I was making the left hand turn. And advice would be appreciated!

Yes, that's what insurance is for, and they should have paid. They were evidently gambling with the fact that the other guy hit you and he was speeding, and hoping it would pay off. But it didn't. Do they know you have been sued? Because if they don't, you need to inform them today. They may take care of this quickly once they find out, but if they don't you will have to get a lawyer. If they give you crap about it, find out who their own attorney is - google your ins co name + legal department, or ins co name + corporate information. Then get in touch with that person and start raising a stink.

This makes no sense. This is what insurance coverage is paid for. If they continue to refuse to pay, contact your States Attorney General or Insurance Bureau.

Yeah, tell them they should be talking to your insurance company, not you, you should also be talking to your insurance company, and figuring out why they aren't paying.

You really might want to get a lawyer involved, to back you up. You have insurance, and this is part of why you pay for it. If you're caught in the middle between these companies. Talking to someone who knows your state laws will help a lot.

You are complaining that your insurance company denied liability on your behalf. That's different.

Anyway, refer the complaint over to your insurance company. Don't get yourself all worked up. This is standard procedure, although usually the insurance companies use inter-company arbitration as a means to resolution. They will continue to defend you, and they will hire an attorney on your behalf. If at some point they wish to compromise a settlement with the third party insurer, they will resolve the matter within your liability policy limits.

If the Police Report states it is your fault, your insurance company should go by that. The other insurance company should be subrogating your insurance company not you. I would also try to get in touch with your States Insurance regulatory department and explain what has happened. Good luck.

Lawnboy is 110% correct on this. Get the suit papers to your insurance company ASAP. If sounds like they denied liability so they would owe to defend the lawsuit for you.

If they had denied coverage then you would be on your own.

Stop worrying your company will handle this.

first two answers are good. most importantly, stand up for yourself and dont assume just because they say your gonna get screwed, that it has to happen.

insurance coverage is like the biggest scam ever and thats what happens in most cases where one doent pay you best be talking with a lawyer and yes you will more than likey be paying for the car and or any meds that they might have file for since you was at fault you pay when your insurance dont some good it does to have it right but thats the way it goes its a goverment thing and its all about the money sorry about the bad news

Sleazy disgraceful insurance companies, if you don't pay em up, the cops will get you. Yet isn't it amazing that even when you pay your insurances in life - which are a complete con, they still decide not to pay.

Always looks like a WIN WIN situation for the insurance companies to me!

Sounds like a case of Deceptive Trade Practices - that's about "three times the money" in Texas!

Take the suit papers to your insurance agent and get ready to report the entire incident to your Department of Insurance!
