passed my driving test at 12 a clock today have the certificate and everything to prove i have passed, one hour after i recieved a phonecall from huddersfields head office for driving saying that my driving pass is VOID and they are wanting to come and take the ceritifate off me, been to the police and they have told me not to give them the certificate back before they have a appeal, i was just looking for some legal advice for wheather or not i have to give them this ceritificate back by law? have they the rights to VOID the pass and make it a fail when they said its because my driving examinor forgot to give me a 2nd monevour to do but i did everything he asked me to surley thats not my fault?

I was a driving instructor for years and never heard of this one. Is it possible that it's just one of your mates is taking the wee-wee?
I think once you've been given a pass certificate that's it, there's nothing they can do if the DSA examiner later finds out there was some inaccuracy in the test. I'd be tempted to ignore it as a hoax for just now, and post it off with your provisional for a full licence as you would normally. If the call is genuine and they are legally allowed to void the pass, then the DVLA in Swansea will let you know. Wouldn't hurt to ask your driving instructor, but I doubt they'll ever have heard of this happening before.

i would get advice off your driving instructor, but at the end of the day they passed you and it's there fault, so even if they do void your certificate they should at least give you a free test as this is just a complete inconveniance to you. and if the police say don;t hand it over i would'nt but like i said driving instructors will know more about this than me. good luck that must be really frustrating.

I would contact them and see if you can go and complete the manuver they are claiming you didnt do.

As for what will happen i can only predict based on experience-- everytime I deal with the dept of motor vehicle, they review everything i give them for my licencing, and if any of it doesnt check out then they make me go fix it before they will reissue any documents to me.

It is not your fault but you are going to have to go the extra mile because of their mistake.

If they (the testing company) realized that they did not administer a correct and complete test they are obligated to A) Void your certificate and B) offer you the opportunity to retake the test at the earliest possible opportunity at no additional charge. Contact them to arrange your re-test.

The law absolutely requires that they follow a written and legally defined testing procedure, if it becomes apparent that they have erred in the procedure then they are required to do the procedure above or suffer the loss of their certification to provide the required testing...
