the car was pulling back with its behind at night..with all lights on. and the other car hit the back bumper on its two doors while it was speeding in a scraping motion. this was on a residential road.

When ever you are going in reverse it does not matter what the other person does no matter how irresponsible it is you are at fault. It does not seem very fair sometimes when you would think that they could avoid the accident but that is part of the rules of right of way. If you never took drivers education you may want to enroll in a safety class so that you will know what you have to do to protect yourself. It would have bee better if you had backed into the driveway to park then when you are leaving you are going forward! Sorry but true! |

The car going forward down the street clearly has the right of way. You can't just go backing (or even pulling out forward for that matter) into traffic or there would be no way to avoid accidents. |

You backed right into the vehicle based on the point of impact that you described. Also, if the other car was speeding, why did you continue to back up? Your at fault. |

Probably the car on the road has the right of way unless they were speeding. Witnesses are nice. Backing out slowly is always the best bet. |
