A preson drived out from Give Way, I followed him, I saw he has gone (he has speeded up already), then I looked towards right, a coming car was far from me, so I speeded up. however, the car in front of me did a very unexpected slamed sudden break (he said he was giving way to the comming car, but he has already got out from the give way and had a quick speed. The car he waited was far from us.). When I looked back to the front, I had not enough time to stop my car. the time he sudden stopped his car on the road was the time I looked right and speeded up. I think both of us have responsibilities. But his insurence company wants me to take all fault. It is fair?

Doesn't matter what the guy did, YOU are following another vehicle and YOU have to maintain a safe distance and be attentive to what's going on in front of you. You obviously weren't doing either. And how do you know the car in front of you stopped for no reason? Regardless, you have to keep yourself out of harms way so in the event somone does THIS, you don't cause a wreck. YOU have to prove the other guy was negligent in someway, like faulty brake lights, and you're going to have a hard time proving that. |

Yup, you didn't exercise due care and caution. What if he had driven off and a pedestrian was crossing in front of your stopped car? You don't move forward without looking forward.

Unless he slammed on his brakes to get you to hit him and you have witnesses....you are 100% at fault....inattention, speeding, or following to close.

I work as an insurance agent. When you rear end someone you are always at-fault.
I suggest just letting it go. Accidents happen and that is why you buy insurance. Yes your insurance will probably go up when you renew. You should buy a policy from another company before the accident shows up on your clue report. So start shopping today. Try and buy a year long policy so that your rates don't go up for a year. Also make sure you use a company that runs a MVR and CLUE report before you buy. Also look for a company that doesn't require a vehicle inspection before purchase. Your current insurance will coverage the damages to your vehicle, assuming you policy is paid to date. So you shouldn't have any fears about switching.
Also try to be nice to your claims adjuster, as being difficult will only make the adjuster difficult with you. Also tell the truth. Lying about an accident can lead to felony charges of insurance fraud.
So is short, take responsibility, get some new insurance today, and be nice to your claims adjuster! |

I hit a car and i had no insurance on my van now the insurance company want me to pay for the settelment but i believe that they payed the guy way too much the car was a write off it was a 2000 jeep grand cherokee with 367054km on it when i have tryed to get black book value for it, it does not give me a price because there are way to many km on it i call a friend of mine a a car deal and he said that the most he would give for that car would be $2000.00 the insurance gave the guy $6300.00 i know that i have to pay but this is crazy i looked on line a the same car with only 182000 km are selling for 5900.00. also do you think that the insurance should provide me with this car if i am the one buying it now?????? |
