We were in an accident where the other person hit our car and then ran off. We were able to take down the license plate number and through our insurance company they found the owner (who has insurance). We filed a claim against the owner's insurance, our insurance company sent an agent to asses our damages and our company was processing our claim, now the other person's insurance says the case is closed due to the fact that our insurance company failed to call them and keep them informed or something, it was very vague. Basically it seems like both insurance companies are just giving us the runaround. Keep in mind that even though there isn't a police report, we did file the claim the same day of the accident and the other party did not do this until we found their contact information and called them to see why they ran from the scene of the crash, it took them 10 days after the accident to report their "side" of the story, since of course they are denying it,(but of course they contradict themselves since why would you not report an auto accident right away or stop at the scene if you wanted to get compensation for your damages?) What can we do now to get somewhere in this case? Serious answers please.

We only have liability insurance on our car.

the first thing you did wrong was not call the police, people who are charged with hit and run by definition "ran". that means the fact they were not at the scene does not matter. the police probably could have found them and made them fess up(and charged them with hit and run). now its a case of your word against theirs, and it sounds like your ins. wont be paying to fix your car? so its not their problem, otherwise they would sue the other company. you dont make clear if you are covered or not. you might have to take them to court. But you can try threatening the other ins. company because of course they will try to get out of paying, have a lawyer send a threatening letter(whether you want to sue doesnt matter, just threaten).
Yes it would be small claims, but there is a $5000 limit on small claims(check locally), once the claim is filed you should be able to subpeona the info you need from their ins. company?(not a lawyer). i think all you need to file is their name anyway. you might be able to get address on internet, white pages, google, etc. |

There is a reason why the other person's insurance company closed your claim, and it has nothing to do with your insurance company. Your insurance company would not process the claim for you since you do not have Collision coverage.
I suggest you call the other person's insurance company and get a proper response. In most states, if a claim is denied, it must be put in writing. Did they close the claim because it was not actively pursued by you? If so, just ask them to reopen it. |

If you have collision coverage, it doesn't matter what the other carrier does. Allow your insurance to pay for repairs and they'll go after the other party, leaving you to move on.
If you have no collision coverage, you need to contact the other parties carrier. A closed claim can always be reopened within a certain period. Find out what they need and supply it. If they're denying liability, your only option is to sue the registered owner. |
