I was at a social event last Saturday, and I was one of the first to leave. When I was walking outside I saw a vehicle leaving before me, it was a truck. I didn't think anything of it, so I got in my car and started to leave. I was backing up, and I felt a nudge. I pulled forward thinking I might have nudged a tree, or what not, and left. I get a call about an hour later saying someone saw me hit someones car. I was already about a hundred miles away, so I told them to have him call me. Him and I have been arguing for around a week now, because his car is totaled, and my car has not one little hint of damage to it. Now that he has taken so long to even try and get a hold of any law enforcement, will his claim hold up? And since this accident, he has been telling me everyday how he has more witnesses. Which I think he is getting multiple people to lie and testify against me for his case to look better, which brings me to my next question, will hear say witnesses hold up in court as well?

But see, I do not wanna get my insurance involved, I have no accident, no tickets, no nothing on my record for two years, my insurance is only 60 dollars a month, and I would like to keep it that way, I am a teen driver with no tickets, nothing, I called them around four months ago, and they said they loved me as a customer lol. I dont wanna change that

OK, well, they'll look at the damage on YOUR car, and the damage on HIS car, and decide that with NO damage, you couldn't possibly have totalled HIS car.
You're going to HAVE to get your insurance involved. Sorry. Your option, handling this on your own, is to hire a lawyer - at $250 an hour - and possibly be on the hook for ALL THE DAMAGES TO HIS CAR, if your lawyer does a crappy job. You can't lose the suit and THEN present the claim for $25,000 in damages and $10,000 in legal fees, to your insurance company, and expect them to pay it. That jeapordizes their defense of you, and voids their responsibilities to you for this accident, in the policy contract.
Unless you have a spare $35K sitting around, call your insurer. File the claim. |

contact your agent. tell them what's going and tell them you think it is fraud. they can get it worked out. the insurance will pay for it but you dont want to have that on your record. something sort of similar happened to me. i was stopped at a light and some lady drove in to my car and then the light turned green and she speed away. luckily i was on the phone and got the license plate number. i called the cops when i got home, they found her and they said they could not give her a ticket because i did not call at the scene. so all that happened was her insurance payed the 3g for the damages to my car. now something like this happened but reversal for one of my clients. same idea. but he knew what he was doing. we paid the claim and that was that, but if he messes up again we are going to drop him as an insured. so make it clear to your agent that you really had no idea, tell themt hat you thought it was so light that it was nothing. |
