Hit & run by uninsured driver, whiplash injury?

HELP!
my stationary car was hit by an uninsured driver who left the scene, I followed and showed the police the house she went into.The police are now saying the driver cannot be found.My insurance company say there are no insured drivers for that car.I am off work suffering from whiplash (I was in the drivers seat at the time)
Police who attended are telling me 'its one of those things' and that there 'hands are tied'.
My insurers are saying they can only proceed with my claim if I pay the excess and will effect my premiums in future/no claims bonus.
Re whiplash, I don't have legal cover on my policy, so insurers won't discuss it.
Looks like I'll be off work couple of weeks, losing pay.

if this driver whom was uninsured lives with a person who does have insurance it would do on that persons insurance.

CONTACT A LAWYER ASAP! I had this same situation where their HANDS WERE TIED but low and behold their not!

Nothing you can do as the police say its just one of those things so do yourself a favour quite griping and get back to work and forget about it, if you pursue it by contacting a solicitor then its just going to cost you more money and your still not going to get any money back! Who are you going to sue?? yourself?? if they cant find the driver then you cant sue him.

Happened to me and my premiums went up! Insurance is a scam! You'll have to claim through the uninsured drivers bureau for the damages and you'll have to pay the excess to get the repair done. Uninsured drivers should be dragged from their cars and beaten senseless

For one thing, If the person who hit you is driving without insurance, then why are the police not doing anything to them.

I would speak to your local CAB to see if they can help you persue this.

...If you can identify the driver you can sue for damages. Contact an injury Attorney to learn how you can proceed. (I'm not sure why the Police are not charging the driver with hit and run and operating uninsured..."If" the police are negligent in their duty... the attorney can sue them)

Try C.A.B. they might point you in the right direction, there is a central insurance fund that covers uninsured accidents. But I think it only applies to fully comp policies.

a personal injury lawyer may help you find out who it was and sue her. If she's uninsured, though, you may have difficulty collecting the judgment even if you win. good luck!

You can claim for the personal injury through the motor insurance bureau 'untraced drivers agreement'. either look for their website or contact the CAB for further information. You won't be able to claim (I believe) for loss of wages or any other consequential loss.

Regrettably you can't claim for property damage under this agreement - you could only claim if the driver was known and was uninsured.

If you claim for damage then you will lose your no claims bonus and have to pay the excess - but of course your insurance company will have to pay out more (probably) again with no hope of recovery.
