How do I title and register a vehicle that I inherited?
If the deceased left a will designating an executor/executrix, or if an administrator has been appointed by the court, the existing certificate of title MUST be signed by this person in order to change the vehicle ownership record to reflect the new owner.

Documentation needed when filing an application through the resident county clerk office includes:

The probated will or certified letters of testamentary verifying the executor/executrix or letter of testamentary verifying the person that has been appointed,
The properly signed certificate of title, and
If the deceased left no will, an Affidavit of Inheritance form must be completed by all heirs and accompanied by a copy of the death certificate.
The application for title and registration and the required documentation is filed through the applicant's resident county clerk office.

Who is the executor of the estate? You will need to talk to the executor if you weren't named the executor of her will. You will need a copy of the will and a death certificate.

If there wasn't a will, it has to go through courts. If she had any outstanding debts, her assets, including the car need to stand good for any outstanding debts.

If your mom left a will, then the executor of her will can "sell" you the car. If you are the executor, you can sell it to yourself, just have to show the licensing department of your county offices a bill of sale or transfer.

If you mom did not leave a will but was married, then her husband can sell you the car.

If she did not leave a will and is not married then you will have to contact the county clerk's office and talk to them about probate. If there is no will, all expenses have to be paid out of the estate FIRST before any property can be transferred or sold.

Only the executor of her estate can get the title put into your name. If you are the executor, you will need those papers when you go to your DMV to make the transfer

Ask DMV about a lost title, or replacing a title. They may not let you unless you can prove it was Gifted to you.

Look up notaries in your area. Call the notary and they will tell you what you need to bring with you, and you bring the title there and they transfer it for you.
