Sorry about your loss. The law of the land says that a will must be "proved" to the Court's satisfaction and then they will issue you (assuming you're the Executor) a Grant of Probate. That is the Executor's authority to get on and deal with things.
You will have to prove to the insurance company's satisfaction that a) your mum has indeed passed away (for this you'll need an official copy of the Death Certificate, or sometimes the original) and, b) you have the authority under the Grant of Probate to make the claim. |

Life insurance should not be a part of probate. The check should be sent to the named beneficiary on the policy. When there is a will, probate is necessary to prevent anyone from coming forward and making a claim against the estate. |

The old saying is the only sure thing is death and taxes. But taxes owed and creditors claims even go beyond death. If goes to probate to assign someone to take care of all claims against the estate and show proof to the court that things were done in a proper way, and not just hand the cash to someone left behind, even if you are the only one in line to inherit. |

If your mum only died last week Foxy you are in for another shock. Getting a grant of probate may take a lot longer than you think and the fact that you are the sole beneficiary is neither here nor there.
The insurance company will require a copy of the death certificate and at least a certified copy of the grant of probate before they will release any funds and then will release the funds to who ever is named as the executor of the estate and not to you directly unless you are also named as the executor.. |

The will has to be proved valid. That is what the Probate court is for. You can do probate yourself. For a simple will it is not too hard. You will save a lot of money in Solicitors fees |

If your mum made a will then it has to go to probate first. There may be outstanding bills, rent, mortgage credit card accounts, council tax, they all have to come out of your mums 'estate' You will need a death certificate. Contact the insurers and ask them what stage they're at. |
