You should have called the police and gave them the number. If he didn't make contact with your car chances are they won't hold him responsible for it. Call your insurance and see what they say.

you go to school learn how to be a cop sign up pass become a cop and then look it up on Computer sorry you cant do anything but report the number and say what you seen happen and really i have to say its really your fault i know it dont sound right but they just cut you off you should have hit them in the side and then called cops your the one who lost control of car and hit a tree

No, you can't. The police or your insurance company can of course, but since there was no contact between you and the other car having his information isn't likely to do you much good. This would be deemed your fault for not keeping control of your vehicle.

(a) In General -- Except as provided in subsection (b), a State department of motor vehicles, and any officer, employee, or contractor, thereof, shall not knowingly disclose or otherwise make available to any person or entity personal information about any individual obtained by the department in connection with a motor vehicle record.

(b) goes on to name law enforcement, tow companies with actual possession, and insurance companies with a claim against a vehicle.

If you did not call the Police and report it then you are pretty much out of luck. Even with the wittness it is impossible to prove he caused the acident. Plus if no contact was made it even worse. the police would be able to find this person but there is no where you can find him with just a plate number. Reason being they are worried you will take the law into your own hands.

He's not liable at all. Just because you were avoiding an accident and causing another doesn't mean the other person is at fault. You are 100% liable for this accident. If you only have liability on your car then you're out of luck here. You'll have to pay for the repairs yourself or junk your car. You can't find information by using his license plate unless you are a police officer or a Department of Transportation employee. It's private information and there is no way of you looking it up. You can go to the police but since you never made contact with his vehicle or vise versa they'll do nothing for you. Sorry about your loss

I'm assuming a police report was made. If not, call your local police department and tell them of your dilemma. Depending on your state, I'm not sure if the other party's info can be given to you. If a report was made, the police can work on your behalf and investigate the other party.

The bad news is, if the other car made no actual physical contact with your car, there is nothing that you can do. Here in Texas, the collision would be listed as an "at fault" accident wherein your liability must pay for the property that you damaged - regardless the fact another party caused you to crash.
