I was ran into the back by a car whilst on my scooter ( i was stationary) i had to go to the hospital the next day where they told me i had muscualr lower back damage, impact knee damage, whiplash and a spasm neck muscle, i have since have ot have 6 physio sessions and two trips to a provate doctor, the claim has now lasted 10months and i am goin for a final check up where i think will be the end of my medical treatment.

... I was on a main road, indicating right, stationary waiting for oncoming traffc to stop so i could make the turning, the injuries have lasted even up to know ( thats just my knee) my neck damage has healed only about one - two month ago so they have lasted around 7 or 8 months.

Where did this accident occur? You may not even be tort eligible. To be tort eligible, sometimes you need to sustain a "serious" injury. The definition of serious does vary. A soft tissue injury is not a serious injury.
Anyway, if you are tort eligible, the claims adjuster will evaluate your claim based on the nature and extent of your injury, disability(total/partial) and treatment. Did you lose any time from work? You have very limited and sporadic treatment. Don't expect the adjuster to accept all of the ten months as disability. Not having access to your medical reports, and based on how you describe your injuries, these injuries should have resolved with 10-12 weeks at the most. Your medical records may indicate otherwise.
Your outstanding medical expenses and lost wages will be included in the settlement. |
