if car has run out of tax, and am intending to sell it within 1 week, do i still have to declare it as SORN even though it'll probably be sold within week and taxed by new owner...

Hi jaygee, cover your own backside & do a SORN. If the prospective buyer does not tax the car and it is picked up by ANPR or a spot check, it is you who will be in the frame. |

You have about 10 days to either declare it SORN, transfer ownership, or tax it. At that point, if it is untaxed and unSORNed, the computer kicks in and issues the £80 penalty automatically. You certainly do not have a month, nor does it depend on the car being on the public highway or being spotted by a traffic warden or ANPR camera. |

If it's off the public road then SORN it now, for all you know the the buyer may decide not to buy it.

I would tax it, as it will be difficult to sell without. Buyers will be suspicious if there is no tax. Plus it proves you have an MOT. |

You'll be OK as long as the car isn't kept on a public road & gets spotted by ANPR or a traffic warden: You won't get an automated fine for at least two months, as, for example, if your tax ran out yesterday, you have until the end of February to declare SORN or tax the car, and the fine won't trigger until you've gone at least one full month beyond that.
