I have a 1990 Honda CRX I bought in September 2007. I'd never bought a car in California before and was unaware of the specifics of the smogging policies, so was surprised when I took the paperwork to the DMV and they wouldn't completely register me without a full smog report (I paid the fees, got the ball rolling).
In the week that followed, my car was broken into, and the "car" bag I always keep (containing road flares, jumper cables, documentation, etc) was stolen - the pending title and associated paperwork with it. I've since been in and out of the DMV, trying to work this out. I have bits of documentation that link me to the car and that first time I brought the title with me to the DMV. However, even after I submitted an application for a new title, they still haven't sent me one four months later. Meanwhile, I'm paying San Francisco insurance costs for a junker car that won't pass smog and I never drive.
I just want to get rid of it. What do I do?

Technically, I think the seller is responsible for the smog test.

When a vehicle is more than four model years old, a seller must provide evidence of a current smog certification
This is not "optional", the seller is responsible for ensuring that it will pass smog and may be liable for some repair costs if applicable. |

You paid fees, started the paperwork, still need smog to finish the paperwork, and the paperwork got stolen, correct? then you resubmitted paperwork for Duplicate Title REG 227?
First, they will never send you a title until you show it passes smog.
Will it pass the smog test?

If the title was PENDING, the duplicate title would have been mailed to the prior owner, not you.
