man into the accident. I have been subpeoned as a witness and fear they will do this again. My insurance company will not help or give me advice unless I file a claim with them. Both parties have their attorney's who will probably be at the deposition. They will likely try to turn this on me. Also I do not remember the details now other than that I did not wave him into traffic.

the best thing is for you to get some legal advice, and not from an insurance company since it's their job to find loop holes to get out of every situation that's going to cost them money. try to find a lawyer's opinion, most of them have a free consultation and they give you free advice. if the attorney thinks that the best thing to do is for you to take a defensive against the other parties then it couldn't hurt to be ready, but if he thinks that the other attorney's are just looking for ways to blame other people and come out clean but have nothing on you then you have nothing to worry about.
most attorney's have different ways of approaching a case and most of the time they take innocent people under their feet, that's why you should also take some initiative.

even if you waved someone into traffic it is the responsibility of the driver to go slowly and watch as they enter so what the problem is most likely one did not see you and the other did and boom, That's why people don't like helping other people. when you make your deposition keep it straight and simple and don't let someone try to change your mind in what you did you were there you know what happened on your part and that's all your responsible for. |

you cant be at fault unless there are many people that witnessed you doing this its the persons who got in the accident thats at fault. don't worry too much just show up and tell the truth. they cant say you waved , you can say you were fixing your hair or you had an itch or something was on your face. |

It's never a good idea to wave someone in traffic if you can get blame for an accident. If you didn't wave them in, but let space in front of your car, that shouldn't be your fault. Just keep your story straight in court. Don't let them trick you. |

If BOTH of them, unrelated, agree that you waived this guy into the accident, then you darned well better get your insurance company involved, because YOU can be held liable for ALL damages in most states. |

tell them you were trying to shade your eyes from the sun/ of course this only works in daytime sunny day/ actually they are responsible for there actions unless you are a policeman directing traffic/ go and sit down and be truthful about what you saw. if they accuse you of waving simply say no. i have been in court many times and these lawyers get all carried away. do NOT elaborate on your answers. keep it simple even if the questions are a 40 word sentence answer yes or no if you can go to court house and take in a trial they are open to public so you can get idea on how everything works |
