I am being sued and it isnt my fault need help?

I was in a car accidnet when i had the green light and went. Another car was comming and hit me from the side. The whold party got out of the car and took off except the driver and another person. When the police camed he said he couldnt tell who fault it was, even though i had the green light the time could have been off with the other drivers light. I called the police and had a witness who left after a while. I am now being sue by the other driver and his family, They says the kids were minor but they wasnt there in the car they may have tooken off. They started to run when i call 911. I am waiting for the police report because i know no one was on the scence but me and my sister, the person that hit me and there wife. The officer didnt issue any tickets he said he couldnt tell whom fault it was at all and it just seems to be a accident where i got hit. what should i do i just got the letter this week saying that i am being sue and i need to contact my insurance dept or my lawyer

The insurance companies typically sue each other. Contact your insurance first to let them know what is going on and find out why they would be suing you and not dealing through the insurance companies. You may also want to discuss this with an attorney.

You insurance company should handle this for you...the police report has to list every driver and passenger...don't stress let the insurance handle it...they hit you and the officer did not say it was your fault...there is no record of them being in the car so you should be fine....just call your insurance company, thats what you pay them for!

Contact your insurance company. you do NOT need a lawyer. they do not have your best interest at heart.

if both drivers are stating that they each had a green light, then there is a good chance that the insurance companies will determine that there is not enough evidence to support one version over another. this is considered a Word v. Word situation.

i this case, each driver would go under their own policy. neither driver would be able to collect under the other person's policy. no lawsuits, no lawyers, no issues. this accident would never go to trial anyway.

also find out if the other person has auto insurance. this info will be on the police report. file a claim through their insurance company. if they do not have insurance, you can file through your own uninsured motorist coverage. (if your state has this).

First of all, why are you being sued? Didn't you contact your insurance company? This is what insurance is for. Did the police interview your witness? If you haven't talked with your insurance company, you'd better do it first thing Monday.

It is true that sometimes there are traffic light malfunctions ... I have seen where green both ways same time & it happens intermittently. This is one reason that when driving you need to observe both the signs and the other traffic.

Anyone can sue anyone.

Did you get enough info from the witness so he / she can be found again to give a statement, or is it just your word against the other motorist?

Even though you might not have seen any other witnesses, check with all the businesses around there ... some of them may have security cameras aimed in direction that includes the intersection ... sooner you do this the better, they not store that film for very long.

Go with your insurance company first ... they have lawyers ... your insurance may be sufficient to deal with this situation.

Lawyer is more expensive, but has the advantage that you can counter-sue.

You should find an accident attorney and counter sue, I'm sure one would be glad to take your case.

It is probably just some kid who hit you, fled the scene and went home and lied to his parents who are now suing based on his story.

I wouldn't worry to much. If they didn't even stick around for the police, it just shows the court they are guilty. Judges aren't stupid.
