dont talk to her personally... let your insurance companies deal with it... you can mess things up if you accidently say the wrong thing...

Feeky Chucka
Tell her to deal directly with your insurers. She has no right to contact you directly if you do that. If the damage is only a couple of hundred quid you are allowed to settle without going through your insurers if you prefer. I don't know how much R1000 is... is Rand or Rhial or something?

andi.wilding
just pay what th inurance company says dont pay anything else

CuteGirlsMom
yes, I think you are at-fault

By law you are required to maintain a safe distance from the vehicle in front, as she braked and you hit her you are responsible, so pay up and learn your lesson. Or possible go to Court to get the matter settled, which I feel you would loose and have to pay all the court costs.

You're at fault, I'm afraid. You must always keep far enough back from the car in front so you can stop safely if the car in front stops.

Turn the claim into your insurance company and let them handle it for you. If you handle it yourself and she turns around and says she was hurt because of the accident and wants compensation for pain and injury your insurance might not handle the claim for you.

It sounds like she wants you to pay her deductible. After the damages have been paid, her insurance company is going to go to yours for payment. They will include her deductible in that settlement.

If she calls back tell her to contact your insurance company

Bad weather or not
you should always adjust your driving to the weather
conditions and always be prepared for sudden stops

hitting someone in the rear is always your fault

file the claim with your insurance
that will document everything and make sure she won't
keep asking you for money in the future.

You should have called the police to document
the accident in the first place yet now
all you can do is have the insurance company do that work

don't talk to her any more about the accident or money

be safe and drive looking out for the other guy

In PA the actually section would be Driving Vehicle At Safe Speed. Title 75 VC 3361. Most people call it driving too fast for conditions. Yes you are at fault. I would still plead not guilty and take a chance. Some MDJ's know that accidents are unavoidable and cut the defendant some slack. Also, the other driver would need to be at the hearing. Maybe they would be a no show and you would win. All said, just let your insurance company deal with the damages. Don't make any statements to her or her insurance company especially if they ask if they can tape it.

yes you must pay ..you are at fault ..you were following too closely for the conditions...why do you not have insurance?
you should not be on the road.

i would contact your insurance as you dont know what its going to cost to fix her car. i would never exchange cash before seeing a quote from a garage so you can see the price for yourself some people will try to rip you off as they know most will just pay rather than go through an insurance company as it will affect your premium. if you dont want to go through insurance then get her to get a quote and sign up a written agreement between you with witnesses so she cannot say you didnt pay. as for who,s fault it is i cant help without knowing and seeing your position when driving. good luck

You are at fault, but let the insurance company take care of it.

If u hit someone in the back ith ur car no matter what its ur fault anyways about her tellin u to pay her money dont do it thats why u have insurance her insurance should fight your insurance for the money thats the whole point of havin insurance nothin comes out of ur pocket ur insurance rate might go up tho but thats ok at least u didnt have to pay that lady 1000 dollars

What did she brake for? Were there vehicles in front of her also slowing? Was she slowing due to conditions - rain/slippery roads? Just because she braked does not mean she holds any comparative negligence, if you were not following as closely in these non-ideal conditions you may have avoided striking her. As for paying her for the damages - if you have insurance - it's best to go ahead and file a claim and allow your insurance company to pay it. Otherwise if you have no liability insurance, do not pay anything to her directly - deal with her insurance comapny. They will repair the vehicle in full - and you can make arrangements to pay the insurance company back (much safer option if you have no insurance).

mikeambrose_uk
No, you should submit the claim to your insurers and they will pay it through your insurance. You will, however, lose your no-claims bonus, but if you want to avoid this, you could pay the cash.

Yes. By law you are at fault even with poor weather conditions because the driver is supposed to allow for such conditions and allow for extra braking distance when stopping.
