I caused a car accident and I wasn't insured! What's going to happen to me?

I royally screwed up and defaulted on my car insurance payment. I ended up being without insurance for 2 months..and wouldn't you know it, I got into my first ever car accident. Other than that accident I have a completely spotless record, no speeding tickets or anything. Unfortunately, at the time of the accident, I was uninsured and it is MY fault. The damage to MY car is minor, but his car was not driveable. Neither of us were injured and no ticket was issued by the cop since it was on private property (happened in my apt. complex parking lot) but he did write a report stating it was my fault. So...onto the question...what is going to happen to me? Obviously I'm going to have to pay for the other car's damage out of my own pocket..but I don't have that kind of money. Am I going to be sued? If so, then how do they get payment out of me? Do they garnish my wages? Is there some sort of payment plan? Is anything going to happen to my license? I'm so confused and scared, help.

Okay, if it happened on private property the cops aren't interested and there's no danger to your licence, so don't worry about that.

Looks like you've admitted it was your fault. Either you come to some arrangement with the other guy (which doesn't seem practicable) or his insurance will pay for his damage and try to get their money back from you. It's up to them how hard and how far they push this, with a bit of common sense they may realise they can't get blood out of a stone and accept any sensible offer of payment you might make.

It's a civil matter for them to get their money from you, it is possible they might seek a garnishee order on your wages but if they do the judge will decide what is possible. You won't be left with no money to keep yourself and your family.

You are responsible to pay for the damage to the other vehicle. The other drivers insurance will fix his/her car and then they are going to come after you. You made a choice to drive with no insurance and by doing so, you left yourself wide open to lawsuits, garnishments and judgements. Good luck to you.

The best thing to do is call the guy and try to work something out. If the guy wants to settle with you without his insurance getting involved or he can let his insurance pay and you'll have to pay his insurance company.

If he decides to settle without the insurance company, you can either. Have his car repaired and you pay for it with your credit card, (in which case you'll be making payments) or you can settle with him on some payment plan. However, draw up a contract that you both agree to. Have the contract notarized, meaning the two of you will have to sign the contract in front of a notary. Make sure you have two identical copies of the contract that is drawn up. When you make payments to him, make sure you get a receipt every time. Make sure you keep the receipt. On the receipt write your check number. If he doesn't want to take a check, go with him each time to the bank. Give him the check and allow him to cash it right away. This gives you a back up receipt in case he tries to sue you at a later time.

It's not pleasant, and it may be scary, but you're driving, so you need to take your adult responsibilities seriously. Just make sure you don't get taken advantage of, but do what is right.

Whatever transpires from this accident depends mainly on the laws of the state in which you reside. Some attorneys will answer your questions and not charge a fee but if you have to get legal assistance, naturally they will charge. Good luck.

ok you are NOT going to jail you will have to try to pay for the damage but the other party prob has uninsured motorist ins............ talk to him/her and work something out the cops wont be involved if was on private property. you will NOT lose your license either.

If the other driver had collision insurance, his insurance company will pay for the damage, minus the deductible.

You didn't say how much the damage would cost him, but if it was in a parking lot, I doubt that the damage would be that much, unless it was a brand new car.

Keep in contact with the other driver, tell him you will pay it off in increments (so much per month), and it shouldn't be that big of a problem, and he will not sue you if you set up a pay schedule. Sign a statement that you will pay it off, so much per month. That's the way it should be and we should get rid of these mandatory auto insurance laws.

Even if he had collision insurance, you should pay him for the damage, especially the deductible.

If you had a medical emergency and couldn't pay, you would still be able to pay it off in monthly payments, don't worry.

you are going to have to pay the damages off for the car. try to work out a plan with him so he will not sue you. That is the best thing to do. If he sue you, then they can garnish your wages. The best is to try your best to keep it out of court
