I was traveling down an interstate at about 60mph and my car began losing control. My car started going sideways to the left before it spun all the way around and traveled backwards before it hit a guardrail and messed up the back driver side of the car pretty badly. My trunk won't close now.
I filed a police report and he said he might charge me for speeding but I was going at a reasonable speed for the condition the road was in I believe (a lot of people were going faster than me passing me)
Now I am wondering what will happen about insurance coverage. Will they cover the damages? Will my rates go up a lot of the police charges me for speeding? Will they still go up if he does not charge me for speeding? Additional Details It was actually snowing at the time. I hope I don't get charged for the guard rail. I am already worrying about the insurance... yes I am fully covered. I am so broke right now :(

You were driving 60mph in the snow...the officer would be nuts to NOT give you a ticket!
Whether you get a ticket or not, if your insurance pays for this accident, your premium will be increased. The accident stays on your policy for 3 years.
Since it is a single car accident, you will have to pay your collision deductible. So if your vehicle has $1500 in damages and you have a $500 collision deductible, your insurance will cut a check for $1000 and you have to pay the $500 out of your pocket. Comprende?
The state WILL want the guardrail fixed. They will send a bill to repair the guardrail and for the labor involved in the repair. You can pay it yourself or give the bill to your insurance company and have them pay it on your behalf. But keep in mind, the more your insurance company pays out, the more your premium will increase!

The car didn't lose control.......you did, with the result that you caused damage to a third party's property.
Your insurance should pay for the damage both to the guard rail and your own vehicle, always assuming that you have fully comprehensive cover but your rates may well go up come renewal time.
Best to be upfront and honest with your insurance company or next time they may refuse to pay out. |

1st was it raining? Are you fully cover? and that's the least of your worries they might charge you the guard rail that's why they want to charge you with speeding if only accident no charge so don't get stuck with police report. |

IMO, they will definitely cover your damages. Because it is why you have insurance. It's a single accident and you don't get anyone injured right? :) |

The fact that you lost control in a single car accident is incontrovertible proof that you were going too fast for conditions for your vehicle and driving skill. Either all those people were better drivers than you (not likely) or they were all driving too fast also. There's something to be said for going with the flow of traffic, but still... a pack of people doing something stupid doesn't make any of them smart :) Remember this, especially, in fog!

Yes your insurance will positively go up because the insurance company knows you were in an at-fault accident. So you might as well file a claim and get the car fixed by them and properly, and at low hassle to you. Yes they will cover the damages up to the limits of your policy, that's what you pay them for.
You should always report accidents that involve other people or that damage others' property in any way, at the very least you should settle up fair with the person whose property was damaged. However in a single car accident where only you took damage, well I believe in that case you are not obligated to find a police officer and confess. I've never heard of insurance demanding a police report for every accident repair. |

You will most likely be billed for the guard rail. Payment is between you and the insurance company. If you are charged by the police, your rates will probably go up. |
