Take the VIN# or plate # to the DMV or AAA Auto Club to see if it's stolen, has a lien on it or has "fallen off record" which happens if it hasn't been registered for 5 years or more.
Sometimes the lender has the title if there's a lien.
Sometimes titles get lost.
The seller can apply for a duplicate title at the DMV. It will cost $18 in California. Each state (and country) is slightly different.
Tell the DMV/AAA the name of the person who is trying to sell it. If that's the same name in their data bank, then it's legit. The seller just lost the title.
If the DMV/AAA says it's not the name they have, then that person has no legal right to sell the car and you're giving your money to the wrong person.

No. If the person who sells you the car does not have a clear title to give you, you will not be able to register it or get a title for it.
