I already have 1 x SP30, 3 points from March 2004 and 1 x SP30, 3 points from 2008 and I informed my insurance in june 2008 as I am obliged to inform insurance for any convictions within 5 years. the first SP30 has now come off license, but is still mentioned on insurance details. My insurance renewal is June 2009, my problem is I forgot to inform insurance about a recent mobile phone conviction and when I did notice I genuinely thought that because the 2004 has now expired it wouldn't matter, as theoretically I still have 2 x £60 fines and 6 points still. A few days ago a vehicle smashed into the back of me whilst I was stationary at a junction and my car is a write-off. I am waiting for settlement figure on car, however have recently sent in log book, driving license etc.... what will happen? Would they really be that harsh to not pay out - and would I be in serious trouble for fraud!!!?? I also have a claim for personal injury. Also had to have a hire car and underwriters have sorted a hire car through insurance, had to have a 3 way conference call with DVLA, me and underwriters of insurance, DVLA divulged that I have 1 x SP30 and 1 x CU80 and 6 points, nothing was mentioned by insurance and I have hire car, so will it be ok!!??? OR NOT???

Well first of all you will not be in serious trouble for fraud. But it is in the hands of the Gods whether your claim will succeed. You are obliged to notify your insurers about any driving offences, as you did not tell them about the CU80 they are perfectly entitled to declare your policy void. It is not a case of being harsh, you have a contractual obligation to inform them of any change in risk which you did not do - basically you did not give them the opportunity to say sorry sunshine but you now look like a poor risk so we have to either up your premium or cancel your policy. |

Odds on they will find out anyway so you had better come clean.
My bet is that at the time you renewed your insurance all your convictions were still current and relevant. If so your insurance was and is invalid and you have committed the criminal offence of Driving without insurance let alone fraud.
The truth will surface and you may well be banned from driving (at least) and have a fine and loads of costs to pay.
Your only hope is to come clean and plead that it was a mistake otherwise they and the police will throw the book at you. |
