i live in chicago and yesterday while i was pulling out of a pasking lot, i accidendtly slightly hit a mini van. i hit it on the right rear end. the guy was in the car so he came out. i looked at the damage and it was just scratches. (nothing you really notice or too big) he wanted to get our insuraces involved but i didnt. i didnt think it was necessary given the degree of the accident. so i offered him $200 to get it fixed and not get anyone involved. her took it. but he said to give me my name and # just in case it was more or less to fix it. do you think $200 will cover it? also does eh have anyway of contacting my insurance or finding me? (he only has my name, #, and possible my license plate #) should i worry about anything?

He can probably find you from your name alone. Certainly from your tag. The guy is a stranger . You know nothing about him. It will probably turn out OK but if he is dishonest he could still report the accident. He could even call his insurance company and say a car with this tag number hit him and drove off without stopping, and your goose will be well done. You could be charged with a hit and run in addition to the accident.
It is OK to offer someone money to forgive a minor accident rather than risk an insurance premium increase. Your mistake was not having him sign a release before you gave him the money.
I_______ in exchange for $XXX do hereby release _________ from any further liability for damage done to my car on 02/15/2009. That's all it would have taken.

You most definitely should be worrying! IF you have insurance protection you should always exchange information with ANY driver with whom you are involved in an accident. That is one of the first rules of the road, and just plain responsible adult behavior! By giving the person cash to settle the accident will absolutely NOT guarantee that the person won't come back for more. Had you taken care of the problem the correct way, involving your insurance company, you would have no worries. That is why we are required to carry auto insurance! |

$200 isn't going to fix scratches. NO WAY. It might pay for the rental car, while his car is in the shop.
You're looking at closer to $1,000.
Sure, he can find you - by filing a police report with your license plate. |
