I have not yet spoken with the other person's insurance company, nor have i admitted to being at fault. Should I just wait until the insurance company takes me to court like my mother says? Additional Details The car is registered in my name and my father's name. The insurance is under my mother and my father's names. Im 22 years old. After my last car accident, the insurance gave my mother the option of removing my name from the insurance for being an "unexperienced driver" or pay a ridiculous amount of money for me to remain on the insurance. My mother didn't tell me I wasn't on the insurance until after this last accident. I don't want to contact the other party's insurance company for fear of incriminating myself and I don't know if I would be wasting my time hiring a lawyer since no serious injuries were involved. I now have insurance of my own but I am almost positive that they will not cover the accident since they were not my insurance company at the time of the accident.

Since you were not covered under insurance, then you will be required to pay the damages you caused (only if the case goes to court).
You pay back these damages through your wage or a work-coordination program. Accidents happen, but as long as you mention that you thought you had insurance under your parents and you have your own now (bring it with you), you'll be a little better off.
If you lived with your parents while the accident occured and were dependant on them, then they are also liable for the accident. Their insurance would pay (unless you were excluded) or their wages would pay...
It sounds like a wait game, so wait until court notifies you. |

Why were you driving in the first place? Admit liability now, otherwise you'll have a judgement against you which could cause loads of problems later, like jobs and home purchases. |

Do not believe that insurance goes with the car. It varies from State to State and company to company. Your Mother/Father will be held accountable if their insurance does not cover you since it is their responsibility to add you to the policy. If you are under 18, you will probably lose your license for being an uninsured driver. |

this is a mess;
it appears that your parents removed you from their policy due to your past history of driving which as you said made the premium to be outrageous to keep you on; it also appears that they may have made you an "excluded driver" on their policy which means even if they gave you permission to drive the auto and you are in an accident, they would deny "any claims" for no coverage;
if you are an excluded driver on the policy, it means you cannot drive it at alllllllll
since you are 22, they can go after you personally or may and try going after your parents who own the car; you could lose your license since if there is no coverage, you would be found not to have financial responsibility for this accident;
you need to talk to a lawyer asap and find out what your rights are; it does not matter if you admit fault or not, since the other company if they find you liable will go after someone to recover what they paid; even though you said there were no serious injuries, the amount for the car damages and any injuries could add up to an amount that you maybe not expecting;
dont wait for them to take you to court; you could be charged for other cost other than the above;
once again, get legal advice and do what the attorney tells you to do; some lawyers may give you a 'free consultation" and then you can decide what the best course to take;
your problems are just starting, so get legal advice and find out what steps you can take to nip this in the bud; |

Well if your mom gave you permission to take the car, she's going to be in court with you, in case she doesn't know it. She'd better talk to her insurance company pronto.
If she didn't give you permission to take the car, then you're on your own and you'll have to pay for your mistake and do the right thing....or if it wasn't your fault, learn to defend yourself and talk to Legal Aid.
I presume this is all civil stuff and that you haven't been charged with a crime |

More information is needed or you won't get an answer. What were you driving? Who did it belong to? Did you have permission to drive it? What is your age? Do you live with your parents?
Since insurance goes with cars, not with drivers, if you were driving your mother's car with her permission, you are covered under her insurance. So, if you'd like to give us more information, what I've mentioned already and the details of the accident would be a good start, I'm sure someone can give you advice. |
