Regardless of fault, you always have to front your own deductible. That is why you choose the amount. HOWEVER, you are not at fault for this accident (based on what you've told us you were rear ended while stopped at a red light). Since liability is clear, contact the other insurance company and request they refund your deductible. Most likely they will have no issues doing it - they will just need confirmation from your carrier of the amount of your deductible and that the damages exceed the deductible. |

A deductible only comes into play if your insurance is the one paying. If the other party is responsible for the accident, and they have insurance, their insurance company pays everything. Your insurance and deductible are not involved. |

The other party is responsible for all your damages. Their insured's claims adjuster will come out and access your damage, so will yours, and a check is written. . . no cost to you. |

If yours was the only car involved then you pay the deductable. If another car was involved then your insurance has to make sure their insurance pays the entire cost. |

If you filed the claim on your policy you do have to pay the deductible but you will be remibursed if your insurance company recooperates the loss from the other driver, if you dont want to pay your deductible then file the claim on the driver who caused the accident policy check out globalwideinsurance.com |

You have two options.
1.) Wait until the courts system go through their process and then wait some more until the person who hit you pays for your damages.
2.) Pay your deductible now. Fix the car now and then wait until the court systems to reimburse you for your deductible |

Your deductible payment is what you agreed to pay when you got the policy. It has nothing to do with fault in an accident, if you don't want to pay a high deductible and receive a lower payment, you have that option when signing the policy. You could have chosen to pay a 200 dollar deductible, but if you chose 500 or more, than that is what you will be required to pay. |
