I got in a wreck today and the guy who hit me is telling all these lies?

he's saying that i said it was my fault.

toooooooooo bad i never even said that, he was the one who kept saying it was my fault and i just ignored him (because i was crying) and the only words i said to him was "why did you speed up and hit me, why didn't you hit the brakes or honk?" and "can i have your insurance card?"
literately that's all i said because i was trying not to cry.

and why would i admit that i was in the wrong, really i'm not that stupid.

what's bad is the insurance will believe him over me because he's older....
what should i do???
advice? (this is my first wreck ever)

well see i didn't know what to do, so we just exchanged insurance and then he left. then i called my dad and he told me to call the cops. then i did and they said that it was now a civil matter and they couldn't get involved. so there wasn't a police report.

If you have a police report, that will give details of the position of the cars, details, etc & your insurance company will be very likely to determine who was at fault from the officers notes.
If you did not get a police report, go to your insurance company & give them a detailed statement about everything leading up to the accident- your direction of travel, speed, road conditions, details on the other cars direction of travel, where the two vehicles hit at, etc. Again, your insurance company will most likely be able to tell who was truly at fault from your statement & the other person's statement if he provided one to his insurance company. Just let your insurance company handle this- they are trained to determine who's fault & how much. Don't let it bother you.

And trust me- his age has nothing to do with swaying a cops mind (or your insurance company's) as to who's fault the accident is if all of the evidence points to him as being at fault. I don't care if he has been driving for 40 yrs and you just got your license today- if he caused the accident, the police & your insurance company will not believe him over you just because he is older and more experienced.

doesn't matter what u said.
if he doesn't have a witness to what u said,it is his word against yours.
exchanging insurance information is the only thing u need to do and absolutely report the accident to the police.
if u could hav gotten pics at the scene that wud hav helped.
remember to report it exactly as u remember it happening in detail.

I don't understand how the police didn't get involved, hell the first thing my insurance company asked me after if I was alright was if there was a police report and for the number.

It doesn't matter what he said at the side of the road. Report this to your insurance company and tell them your side of the story and tell them you were not at fault because <insert reason here>. The only thing is if there are no witnesses and the damage does not clearly indicate what happened then the best you can hope for is that blame is assessed 50/50. If you are truly adamant that you were not at fault you could then sue the other driver in court and have a judge declare you 100% not at-fault.

Doesn't really matter who said what at the side of the road. you need to file a report with the police - they should have a form to do that and most jurisdictions require a report be made. you also must file a report to your ins co. they will surely provide you a form to do that. it will probably include a diagram of the accident that you will draw showing how your cars hit and where you both were relative to traffic controls if any. this is your opportunity to tell your side of the story. Ultimately an insurance investigator will have to look at it all and probably take verbal statements from both of you and try to decide who is most credible.
