so my uncle was trying to stop at a stop sign and the brakes went on him and there was a big school bus comin and we couldnt do anything about it. (WE had to stop, and the bus didnt have to) and the bus hit us in the front left side of the drivers side. and rite now i have really bad whiplash. my dad wants to sue my uncles insurance company( progressive). is that ok? because it was BOTH of theres fault. (BOTH speeding)
plz help??!!

Your dad is entitled to collect for your injuries off your uncle's insurance. Your uncle is at fault for not being in control of his vehicle and failure to stop at a stop sign. If by "Both speeding" you mean you think the bus was speeding, that won't matter.

But no, he doesn't have to sue, only file a claim.
