First of all, unless he was backing up, the guy who hit your car is at fault. Your insurance company is likely balking because your boyfriend wasn't an insured driver. If this is in fact the case, you'll never get a dime from your insurance company. Your insurance policy (the fat folded up stapled letter you probably got in the mail but didn't read - nobody ever does) will tell you who is covered to drive your car. It could be that you are the only person covered. It could be that your boyfriend didn't have a current drivers license, or had an outstanding warrant, or has had too many points taken off his license for previous violations, or was in some way violating some law at the time of the accident.

Find your policy, the police report detailing the accident, and call an attorney. Look in the yellow pages under attorneys. You need an accident attorney. Accident attorneys usually also do personal injury and property damage cases. The initial consultation will cost you nothing. If an attorney wants any money up front, find another one. Worst case: you get an initial consultation and the attorney tells you he can do nothing for you. You've wasted the time and energy it took to go to see him, but at least he's going to be able to explain to you what's up and probably recommend what changes you could make to your policy to protect you in the future. Best case: his eyes light up and he sez "I'll take your case!!" Ka-Ching! If he takes your case, you pay zip, nada, zilch unless you win.

I assume your boyfriend was required to be a named driver and he was not. If that is the case, then of course the insurance company is well within their rights to deny coverage. Usually however, if a person has permission to use a vehicle, is not a regular user, is not specifically excluded, there is coverage.

However, you were rear ended. Contact the other party's insurance company and file a claim. They do not care who was driving.

It is the fact that you didn't have your boyfriend listed on your insurance. In order for him to be protected his name MUST be on the insurance. You will likely have to consult with a lawyer in order to get anything from this. Once this has passed, you will NEED to put him on your insurance policy if you plan on having him covered in the future. The first consultation with a lawyer is normally free and allows you to determine whether you will need their assistance.

Was your car parked? Do you have COLLISION coverage? It doesn't matter if your car is driving or not. If you have COLLISION coverage, your insurance should pay. If you have no collision coverage, then you have to sue the other guy, or try to file a claim under his insurance, IF he has any.

If YOU have no coverage - ie, you didn't buy collision, then YOUR company won't pay. You might need to sue the other guy.

If you DO have collision coverage, then they should pay. Minus your deductible, of course.

On the other hand, if you have collision, and your BOYFRIEND was driving, and you didn't list him on your policy, and your policy says, you have to list all drivers, well, they don't have to pay. You need to list all regular drivers on your policy. Add your boyfriend as a driver, and next time, it WILL be covered. IF you have collision.
