I was just wondering.....
I got into a car accident that was 100% his fault. I have no insurance and he did. My car got impounded and was wondering a few things....
If the police report says its his fault, would his insurance people fix my car or get it out of impound or anything?
Or am I just screwed because I had no insurance?

You have two issues here: First you have no insurance which is a violation of the motor vehicle codes and you are subjected to fines and if that is why your car was impounded, you will have to pay your fine and show proof of insurance usually SR-22 and pay the impound fees to get your car back. Now, the second issue of damage to your car, his insurance is liable for your property loss and personal injury if they are the result of the accident and the accident is in-deed the other driver's fault. Your lack of insurance does not eliminate the other driver's financial responsibility and obligations. |

A friend of mine got into an accident with out insurance and it wasn't his fault either. The guy who hit him, his insurance had to pay but my friend got his liscense taken away for a year because he didn't have it. So they will probably pay for it but you might get your liscense taken away. Hope you didn't get hurt in the accident. |

You're screwed pretty much. They can even argue that it was your fault, now, cause now you have no insurance company to stand up for you |

they will fix your car but it won't matter because you'll be suspended for 6 months. and you'll have to fill out a special form at the DMV which might cost you a couple hundred dollars to get your license back |

This other person could change this into a BIG lawsuit. You were on the road without insurance. Therefore, if you hadn't been there, it would not have happened. I know if I was in his situation, I'd sue. I'm talkin' BIG lawsuit so that the judgement against yhou would be substantial to make a point. |
