I got into an accident and I have insurance, can the lady I hit sue me directly for pain and suffering?

I have insurance (thats the main point) and she cut me off and slammed on her breaks so I was basically forced to hit her, but it was technically my fault because I was "following to close) psh... but anyways I was wondering if she can sue me directly or if she has to sue geico. Geico called and said that her lawyers haven't accepted any settlements and only have till october, but Geico told me to call them immediatley if I hear anything from their lawyers. Can she sue me directly?? I'm a struggling college student and can afford to be sued lol...

No need to worry. Your insurance will handle any lawsuit up to the limits of your policy coverage. Even if she sues, the vast majority of claims are settled before trial AND within your policy limits.

She has to sue you, she can't sue your insurance company, but it really is no big deal. If she sues you just get the suit papers to your insurance company and they will assign a lawyer to defend you free of charge.

It is highly unlikely that any money will come out of your pocket for this thing, so just try to relax and keep in touch with your adjuster so you know where things stand.

limits of the policy verses what she thinks she may get in court but she will need doctors proof of her injuries and that those injuries exceed the amounts u have on ur policy.

sometimes ppl initially refuse the limits hoping the other party will "up the ante" but eventually take the paycheck.

If that lady's attorney decided to sue, you will be named on the complaint.

Once you contact your insurance company, do not talk to anyone else. Their attorneys will take care of it all. Medical included. Just listen to what they say and if the other drivers attorneys try to contact you give them the number to Your insurance adjuster, and then you make sure you contact your insurance adjuster also. They can not harass you.

No she can't sue you directly unless your limits for Bodily Injury are too low and she was severely injured, What Geico is saying basically is that other persons attorney (if she has one) is not accepting your insurance co.'s offer and may file suit. Your insurance co will still protect you though
