I got my license suspended, but I only have my permit?

I was with a friend after a party and we got pulled. The cop found an open container of vodka someone had left that we were unaware of (her car is an expedition it was in the back). She had her license and I had my permit (but was a week away from getting my restricted license which I NEED for school..) We went to traffic court about 2 weeks after it happened, but I am 15 and she is 16 so we have to wait a while for Juvenille court. My question is can we still drive and can I get my license until we go to court? And once we are there will they suspend it then? Or was it just automatically suspended once we were pulled? South Carolina law is SO slack me nor my mom have gotton any really solid answers. All is appreciated.

My friend went to court today (the driver) and her license is NOT suspended? Soooo all of you are wrong.

So your mom would actually LET you drive after you went to a PARTY with alcohol involved at the age of 15 years old?!?!? What type of punishment did your mom give you? I know if I was 15 and got caught coming home from a party with alcohol in the car, WHETHER OR NOT IT WAS MINE... I would have been GROUNDED for months and NOT be allowed to drive AT ALL!

Anyway to get to your questions... you need to hold off on getting your license until you hear from the decision at the Juvenille court. Oh and don't drive unless the Juvenille court sd its ok

No, you can't drive.

Your ability to drive is suspended.

It doesn't matter if they call it license, permit, driving pass, or anything else.

You are not allowed to drive, end of story.

Also, you don't NEED a permit or anything else. There's public transportation, and if you refuse to use that, I'm sure you can carpool.

You are innocent until proven guilty, so the suspension will not take effect until the driver is found guilty of the violations charged against them, and that is the penalty selected by the DMV or traffic court judge. A suspension is only one option available as punishment- it doesn't necessarily mean that is what will happen.

If you had no alcohol in your system & was not the driver, your permit should not be affected. If you were found with alcohol in your system & even though you were not driving, you were in violation of state laws pertaining to alcohol & teen drivers- this can be used against you then.

Driving is only a privilege, not a right. The state is under NO obligation to give you a driver's license- ever. If you "need" a license for school, then you should have been more responsible than to be underage and at a party that had alcohol.

No, you can't drive. and no, you can't test and get your license.

Chances are, since alcohol was involved, when you get to juvenile court you will not be able to even start the process to get your license until you are 18 years old. I don't believe for a minute (and neither will the judge) that you had no idea the Vodka was back there. Especially since you were "coming from a party" when you were stopped. What was the reason you were pulled over in the first place? Police don't just do random stops to annoy you.

As far as "needing" your license, no, you really don't, and if that were true, you wouldn't be riding around with a 16 year old and an open container. It's the old concept of choice-consequence. You make choices and there are consequences to those choices. In your case it's going to be a bad consequence.

By the way, the best source of answers will be your attorney. You do have one don't you? You'll need one.

If a license is to be suspended...it will only be for the person who was driving...not the passenger.
