I got stopped on the 31/07/08 for caring 6 passengers. I am insured for 6 passengers. ?

Most driving laws require a seat for each passenger and additionally require children, depending on age and size to be in a car seat and/or seated and buckled in. Children seated on an adults lap will always be considered a safety violation, unless you live in a third world country.

If the car you were driving only has 5 seats and 5 seatbelts then unfortunately you are breaking the law. The only time you would be insured to drive more people was if you were in a 6-7 seater vehicle.

You can be insured for 50 but if you only have seat belts for 5 you can only carry 5. And that is without the booster seats etc for the children.

The Police are right to charge you.

You placed the child at extreme risk and in the event of an accident also in the event of a frontal accident you could have placed yourself and your front seat passenger in danger of death or injury from the child being launched forward.

You should never allow a child to sit on the lap of an adult passenger.

No doubt about it, you broke the law. Unless your car was a 7 seater there shouldn't have been 4 adults in the back. Even if it was, the child should have been strapped into a child seat or booster seat by law! Not on an adults lap. Also, by law as the child was under 16 you are the one who can get charged and fined. There isn't any point in appealing as you are simply in the wrong.

You cannot have more people than seat belts in most places. You cannot have children on laps. If they are old enough, they sit in belted in with a seat belt, if they are not old enough, they must be in child seats.
You could be insured for 100 passengers, and it wouldn't make a difference if you had 6 people in a 5-seat car, you would still be breaking the law, not to mention endangering the life of a child who would shoot like a rocket into the windshield in an accident.

AFAIK the only production car with 6 seats is the Honda FRV. Even then it still only has 3 seats in the back and 3 in the front of course)
