I had a car accident. Go thru insurance OR not?

he probably doesn't want to go through insurance because he either doesn't want his rates to go up, or he doesn't have insurance. The thing is he can take the money and then still sue you, so you'll be in big trouble then- I would go through insurance

Always go through your insurance. Because if you just give him cash, he could sue you for more than what you paid him. By going through your insurance there is a guarantee.

wel most likely he dont want to turn it in and really you should have call the cops to fill out a report and how is one to know if thats what it would cost to repair it or is it he just wants money .. but what happens if he turns it in after you pay him and then you stil have to go thru it again back a long time ago we didnt need insurance because most people handled it their selfves which is the right thing to do really but smarter to go thru your insurance its what your paying it for right

i wonder if he is even insured? if you feel safer just go through the proper procedure, it can bump you premiums up yes but at least its legal, how much damage have you really inflicted upon his vehicle anyway? and what gives him the right to ask for that much. beware

I wouldn't, but if you go this route I would get something in writing and have it notarized...this way he cannot come back and sue you. make sure you put in the note that this is all you have to pay and if something goes wrong with the car in a later date you are no longer responsible to cover it. you have to cover yourself at all angles if you decide to not report it.

There is a chance that you were caught in a staged accident.
If so the guy is a crook and the sooner you get legal representation the better!
Filing a police report, and informing your insurance agent is something that needs to be done always. It is a form of protection.
I was rear ended once and at the scene of the accident the other driver said every thing was ok. Well I filed a police report and called my agent. Two months later I got a call informing me that because my brake lights did not work I needed to pay for his damage and medical payments. I just referred him to my agent and the police department.
Never heard another thing about it.
By making payment to him you are accepting the blame for the accident completely. Never admit fault at the scene or in a conversation. Let the courts decide.

I did that once, settled for cash, six months later I got a letter from his lawyers taking me to the cleaners for personal injuries, ie wiplash.
I had got him to sign a not saying monies paid were 'full and final settlement' ....got me off the hook....take care

You think he cut you a deal. Personally I wouldn't deal with a cash transaction to avoid reporting it to your insurance company.
