I am sixteen and have had a driver's license for one month. Okay, so here is what happened. I was driving in the parking lot when I came to a stop at the white stop sign painted on the road. I had already anticipated a car coming from my right, so when I stopped, I looked right and then left. When I look left, I see a car stopped (he had either turned from one street or gone straight from the other street). I did not know why he was stopped though. I was not blocking the road and did not come up at the stop sign fast, but maybe he thought otherwise? I had no clue.
I was making a left, and he was going straight. We were both looking at each other wondering who was going to go. I didn't understand because he had the right of way (no stop sign or anything), and if he was being nice and letting me go, shouldn't he have waved me on? So, I see he is not going, but just as I go HE GOES and ends up hitting the front driver's side of my car (well, my dad's car)- a 2000 Focus. The police offer said it was my fault, of course obviously, since I was at a stop sign.
I tried to talk to the driver, but he did not want to speak to me except for insurance stuff. He was sixteen like me, seemed very nervous, and his mom came and did all this stuff for him and helped him with everything. But I still think he was partially at fault...A. He had the right of way, so why stop? B. If he was letting me go, shouldn't he have waved me on? C- Well, hitting ME. Playing devil's advocate, I could've waved him on as well. But oh well. His mom was VERY mad at me (he only hit me like at 5mph, a few dents to my car and his, so not a big deal.) But his mom was freaked. So, my question is, do you think he's partially at fault? Should I tell all of this to the insurance company? Also, general comments about this and what I can do to help myself and/or my parents.

Depending on what state you are in you will be found to be "at fault." However, the other driver might have some comparative negligence that would reduce your fault percentage from 100% to 85% or 90%. |

Tell the truth to the insurance company. They will send an investigator out and will also take into consideration the police report before they make a final decision. Chances are your will be held liable if the police have made that determination. Your insurance rates will go up and it is something you will have to deal with. I don't expect you to get sued because no body was hurt during the event.
It will just cost you some points on you license and increase the cost of driving through insurance premiums.

Yes, cutting through it all, you are at fault. He had the right of way. You were turning left which means you have to wait until the way is clear. He was going straight, which means he had the right of way.
All the rest of it, him stopped, eye contact, his mom, etc. is beside the point. You are at fault. Your insurance will take car of his damages. |
