the guy who hit me dosent have good insurance,and my attorney said you will not have that much money from the claim,and im almost disable ,I dont know how to deal with my attorney or what i have to ask her if she cheat or not ,i live in va,please i just wanna know what is my right and what to do?

If the other party has low bodily injury liability limits, the maximum on their policy is the maximum you can collect. You will be giving away 30-40% of this amount to your attorney, plus expenses for her doing nothing for you. If the other party has low limits, with your injuries you probably would have been offered the policy limits WITHOUT an attorney & you would have gotten the whole amount, you just gave away a huge chunk of your settlement. Now, if you have higher limits than the other party, you have matching uninsured motorists coverage that INCLUDES underinsured motorist coverage, you may be able to collect under YOUR policy for injuries. I don't see that your attorney has mentioned this to you. Maybe she did but you didn't say anything. Since you have hired an attorney, you may have to use her to file an underinsured motorist claim (again, if you have the coverage & if the coverage is higher than the at fault party's coverage) against your policy. If you do not have uninsured/underinsured motorist coverage add it, if it is minimum coverage raise it, if you have low liability coverage, raise that too. Call you insurance agent & get better coverage. |

What he means is the other party didn't have much liability coverage and the limits will be met long before you are finished with medical treatment. Since you hired a lawyer you can kiss at least 33% of ANYTHING you get from the other party goodbye. |

i think he is saying that his insurance has a lower amount of liability for damages. do you have under insured overage?
you will be splitting whatever damages you might receive with the lawyer, up to one third plus expenses.
you may want to just go through the other guys insurance company by yourself.
what are his limits and what is his status in life, ie does he have anything of value like a house or a good job.
with that information, you should be able to make a smart decision. be careful with the attorney though, what did you sign or agree too, you may still owe him if you drop him. |

The dude who hit you has low bodily injury limits... his carrier cannot pay anymore then the limits he has.
For example.. say he carries 10,000 in bodily injury.. that is the most you can get... regardless of your injury.
And since you hired an attorney... you wont even get that.. youll only get around 6666.00. Doesnt sound like such a good idea to get one now huh? |

get a new attorney. did you carry under insured motorist coverage on your policy? If you did that may help you. you could then file a claim on your insurance and they will get the money back from the other company or the other party involved. |
