I have 6 points on my provisional licence, I run the risk of having 12 points on my licence?
Find answers to your legal question.

I have 6 points on my provisional licence, I run the risk of having 12 points on my licence?

If i get 12 points on my provisional licence, can i still take the practical driving test?
Additional Details
I'm not saying i willl have 12 points, it's only a question, so i will know the risks, and i will avoid them as much as i can. I want the answer of someone that understands this, not silly answers and your sarchasm.

As you went to all the trouble of contacting me by email to ask me to answer your question, the least I can do is oblige :)

If you have 12 points on your licence before you take your driving test, you'll be disqualified from driving for a set period under the "totting up" system and you won't be able to take your test until the period of your disqualification has ended.

The 6 points you already have now on your provisional licence will be transferred onto your full licence when you pass your Practical Test.

Any further points (under the limit of 12), will also be transferred onto your full licence.

From the day anyone passes their Practical Test, they are then on a 24 month "probation period" under the Road Traffic (New Drivers) Act 1995 - this means that if you get 6 or more penalty points on your licence within two years of passing your driving test the DVLA will revoke (take away) your driving licence.

Penalty points are valid for three years, so any points you already have on your licence before you pass the Practical Test count towards the total of 6.

As you already have 6 points, they will be transferred onto your full licence when you pass your Practical Test, as will any other points you may get between now and when you eventually pass your test.

Anyone with 6 or more valid penalty points on their provisional licence when they pass the test for the first time will be granted a full licence in the normal way, but ANY points earned after that will trigger automatic revocation.

If this happens you will have to;
1) Apply for a provisional licence again,
2) Pass the theory test again,
3) Pass the practical test again

Passing the test again does not remove the penalty points which remain on the new licence until the three year period expires. If the total of valid points reaches twelve, the driver risks disqualification.

So to sum up your situation;
1) You can take your test provided you don't go over 12 points
2) Your current points will go onto your full licence
3) If you get ANY more points in the 2 year period after you pass your driving test, you will lose your licence.

I know you feel people are having a go at you, but they're right...facing 12 points already as an unqualified driver doesn't bode well does it!

You need to think very carefully about the way you drive...a car is a dangerous machine and it needs not only to be physically handled safely but the ATTITUDE of the driver is just as important.

I'm not going to preach - but seriously, please for everyone's sake, THINK about what you're doing...and sort yourself out before something awful happens...to you or someone else.

As Dave said - get a good driving instructor- please, for all our sakes :)

EDIT- when you say "driving on your own", as a learner driver this is illegal and comes under the definition of "driving otherwise than in accordance with a licence" - a legal term which covers various offences, including learner drivers driving without proper supervision.

The maximum penalty for driving "otherwise than in accordance with a licence", is imprisonment from 3–6 months, a fine of up to £1000 and 3-6 penalty points and magistrates also have discretion to impose a driving ban.

Until you pass your test you must be supervised by a person over the age of 21, who has held (and still holds) a full driving licence for the category of vehice being driven, the vehicle you drive must be suitably insured to be driven by a learner and must display L-plates.

It doesn't matter "where" you drive, the law still applies.

2nd EDIT - in response to your email. Yes you must display L-plates even if you are accompanied by a person over 21. As I said previously "you must be supervised by a person over the age of 21, who has held (and still holds) a full driving licence for the category of vehice being driven, the vehicle you drive must be suitably insured to be driven by a learner and must display L-plates" - ALL of these conditions apply until you pass your driving test.

I've given you a couple of links to more info about the New Drivers Act below;

12= a ban

Your insurance is gonna be a small fortune !

cuddles_gb
Nope, 12 is a ban - you really messed up. You will have to wait until some of the points expire - though I'm not sure I want you on the roads if you've managed to get that many points as a learner!

I'm afraid I have to agree with most of the "silly answers" and "sarchasm" (sarcasm) above.

If you get 12 points you will be banned, and if you are banned will not be allowed to drive nevermind take a test. Your insurance will also be ridiculously high!

Why do you say "I run the risk of having 12 points"? How? what are you doing that would cause you to get another 6 points? I am not being silly or sarcastic when I as this, I am serious - how are you gonna get 6 more points? I find it hard to understand how someone can get 6 points before they pass their test anyway? And if you drive safely, and legally then I don't see how you can get more points!

Please update question :)

Blink.
Sounds like you're an irresponsible driver, you deserve to be banned.

Sorry, but in this case, points do not make prizes!

If you've already got 6 points, and you think your going to get another 6, sounds to me like you should not have a licence at all.

Edit : Sounds like I've been told off, "silly answer, sarcasim". No, just the truth and the truth hurts!
Still sounds like an irresponsible driver to me, "I will try to avoid them...."

sweetie
no as your licence will be suspended

Can i ask the question how you have so many points already on a provisional licence, am i not right in thinking you are Still being taught to drive!

And if you now face a ban with 12 points looming your instructor should be called into question.

On the other hand have you been driving around ALONE without passing your test first.

sholaouk
Just one additional point for anyone holding a provisional licence, the person supervising you in addition to being over 21 and holding a full UK licence for the category of the car you are driving, must have held the driving licence for a minimum of 3 years in order for you to comply with the conditions of your licence.

If you do reach 12 points you will lose your licence and won't be driving anything for a while, let alone take your test.

You're clearly not doing your driving with an instructor. I'm also afraid your attitude needs some adjusting, it's not a question of "avoiding them as much as you can." If you drive properly and legally you won't get any!

And I'm sorry if you don't like it, but those are the facts.

Please punctuate properly folks.
Even if you get no more points, your first insurance premium, and subsequent years until 5 years from those points were applied, will be very high. Please don't even think about not disclosing these points to your insurers, as they check with the DVLA anyway, and if you "fail to disclose material fact" in arranging your insurance, that company will dis-own you, and tell all the other insurers what you did!

Keep your licence clean! I manage, 25 years now with a clean licence and no accidents.

You may want the answer of someone who understands, but I'm afraid I do not understand how someone with a provisional licence can have 6 points. I am with a lot of the other answerer's, you should not be allowed on the road until you have learned to drive properly.
