on Wednesday April 1st i was involved in a car accident on the interstate i was at a complete stop and this guy rear ended me then a woman hit his vehicle after that.the state police was contacted and i trooper was dispatched to the scene and he ask me what happened and i told him i think tickets were issued to the other to not for sure because he told me that i could leave the scene. on friday i contacted his insurance company to see what was going on since i hadn't heard anything from them and his insurance company said that the guy is denying that its his fault so that he doesn't have to pay anything hes blaming it on the other woman stating that she hit him then he hit me but that's not true he hit me going about 40 or 50 busted up my whole rear end and made my console that has the radio and air, heat, and defroster fall out and now nothing works and my car is acting very weird.now i dint have reliable transportation because of the stupid man . my insurance company isn't helping me out at all since i only xrays and they said that i have a cervical strain in my neck i have liability insurance i also went to the er the next day to get e so do i need to file a petition and take him to court to get this settled because i need a rental car really bad and mine fixed or a new car. i need help what should i do?

Simplistic answer. He hit you, and owes you for your damage. If he is less than cooperative, contact your agent and get help. If the cause of him hitting you were the actions of someone else, he can get what he has to give you back from the insurance of that person. But no, you don't have to go to the first car to claim. Just talk to your agent and he will give you the steps, or hopefully file on your behalf. |
