I have a question about my car accident?

In October 2007 I had a very bad accident. It was about 4:00pm and I am driving home. When I make a left turn at a 4 way stop sign, I clearly didn't saw anyone crossing the cross walking. So I make a left turn, when I almost finish turning suddenly I saw an old ladies walking on the cross walk. So I break immediately and my left front bumper hit that old woman. She had a little injury and my speed is less than 10mph. When the cops came they ask me questions and send that woman to the hospital. The cops said that she'll be fine, it's just a little injury. Then about a week age, my insurance company call me telling me that that woman got a lawyer and the lawyer said that she injury vary bad. I worry that my insurance company won't pay for it and I had to pay it myself. I also worry that she gonna sue me, cause I don't have money to pay for it. If she sues me, I guess I'll have to file Chapter 11. Can someone please answer my concern, thank you!!

Whenever a pedestrian is struck by a car, its about a 99.9% guarantee they will hire an attorney to represent them.
The attorney will always use words to make you think that the injury is more serious that what it was.
Let your insurance company handle this. If you had valid coverage for the date of the accident then there should be no issues.
If the attorney decides to file a lawsuit, your insurance company will defend you at court.
Chances that you will have to pay and file chapter 11 are very slim to none.

First of all, not to worry, as worrying does not solve anything. I am sure that injuries can gt progressively worse, even for podestrians. I was in a MVA and felt no pain until 3 weeks early. So it is possible for her ot be initially fine, but then later show more injuries. However, for it to be true, she has to have medical records to verify that. You should get a copy of the police report so you have proof that she wasn't not too hurt. Also, generally in cases like this, the insurance company would take care of the bills. If you do not have enough insurance to cover the bills, that is when she could sue you.

I am not familiar with Chapter 11 or anything like that. She may not even want to sue you. She probably jsut doesn't know how these things work, so she got a lawyer to help her through it.

First off you have liability coverage on your policy, which covers bodily injury to another person, so your insurance company will cover you up to your limits after that your on your own, but remember they cant sue you for what you don't have. Most insurance policies I come across have about 30-50 thousand minimal for bodily injury coverage per occurance, so that should hopefully be enough, unless the old lady needed a new hip.. The worst that could happen, is your coverages run out, and they take you to small claims court, and put a judgement on you to cover the rest of the suit, and again, they will look at your financial status to see if it would even be worth going after you.. CUZ THEY CANT SUE YOU FOR WHAT YOU DONT HAVE... GOOD LUCK MAN..

Find your copy of your auto insurance policy. Look at the policy and find out what limits you have for Bodily Injury.

Chances are, if you have no money & no assets (no house, car, etc that can be sold and money turned over to the woman), the atty for the elderly woman will go to your insurance policy to receive payment for the woman's medical bills.

However, your insurance company will ONLY pay out what you pay for in coverage. This is why it is a very bad idea to only pay for state minimum requirements when insuring your car. Yes its cheaper monthly payment to go state minimum - but in case of a serious accident your going to pay out of your own pocket & have wages garnished or worse have liens against your home/car/etc.

In my case I carry 500,000 CSL (combined limits). Meaning if I ever have an accident that is my fault, the damages/medical payments/etc will have to be over 500,000 before anything comes out of my own pocket. Yes - I pay 30 per month more then someone with minimum state requirements - but I sleep easier knowing I never have to worry about being sued over an accident or not having enough coverage :-)

Speak to your insurance agent or claims dept at your insurance company and ask them questions regarding your policy and how the claim will be paid/ handled.

Unfortunately you can be sued personally by the lady but not very likely. 10 mph is pretty fast and she could have very well been hurt. Most likely she and her attorney will settle outside of court. Most attorneys do not want to go to trial. You need not be concerned. Your insurance cost will go up on next premium or you will be dropped. You can go to my site and get new rates from local agents in your area should you need another company.

You got it , They may just go after your insurance coverage limit. It doesnt make alot of since to suit someone without money or assets. Usually lawyers take bs cases like this on a contingency and wont bother if the person at fault has no money. If they do you got it you'll basically have to file bankruptcy.

But seriously, She has up to 2 years to claim any injuries. You should be talking to an insurance agent first and then maybe an attorney.
