I have go to court for driving without insurance, but the date of the offence is wrong on the summons?

I want to know if I can get away on that account? I still have the original document that states one date and then another date on the court summons?

Please help

Were you driving without insurance? Then admit it, sort it and move on.

Don't try to wriggle out on a technicality if you know you were in the wrong. Actually, do try it - then the magistrate can increase your fine for trying it on.

Yeah, I would make a big issue of this to the judge, irritate him some more, while you explain why you were driving without insurance. It will not be dropped, you will not win. Provide the proof of insurance, you have since gotten, pay your fine and move on. If you have not gotten insurance, plan on hearing about it from the judge.

You can ignore the baying mob above who seem to want your blood, simply because you have the temerity to ask a question.

The Crown are obliged to provide you with sufficient notice of the essentials of the charge, in this case that includes the date of the offence. If the document you received which sets out the charge has the correct date then there's no chance of wriggling out.

If, however that doc. has the date wrong then you should plead not guilty as the court cant hear evidence about events on a date other than the date of the charge, so the prosecution case would be inadmissible.

If the error is noticed, the date can be corrected, at which point you should plead guilty. If, however, the prosecutor doesn't notice the error on the charge sheet before the crown closes it's case, you'll be acquitted.

It's not a strategy that's likely to succeed, but mistakes can cause prosecutions to fail. No-body's perfect. Look at you, you forgot to get insurance!

Yeah, you can get off. Then, as you're walking out of court, they'll slap another one you with the correct date, if they've got any sense.

Dry your eyes, go to court and just admit you didn't have insurance. Be thankful that you didn't crash the car and injure innocent people. Hopefully you'll learn from the lesson.............no, I can see you on here again moaning that the policeman/woman was dyslexic.( No offence intended to any person who has dyslexia.)

LOL, if you were driving without ins. A clerical error oes not nullify a violation.

Won't matter the law is the law. You need insurance to drive. Even if the police officer does not show up the judge may still convict. Also if yoou can get insurance dated between the two dates he may just fine you and not have it go on your record. no matter what i suggest you bring proof of insurance to court or you may lose your right to drive and a huge fine.

**** what all the ***** on here are saying mate I used to drive without insurance and so what. If anyones got a problem with it give me ur post code and we can sort it out face to face. People act like just because you dont have insurance it means you speed more than everyone else and you hit people more than everyone else and you go around damaging other peoples **** and then running away and doing it all on purpose for kicks. **** these *****. I think a really good lawyer might be able to get you off in ur case but hes got to play it out just rite. Some people have good reasons for not being insured.

A smart lawyer might get you off, but that'll only postpone the inevitable. You'll just get another summons with the correct date on it - plus another set of lawyer's fees!

You may be able to petition it when you show up in court, however most likely it will not be dropped just because someone made a typ-o, as they too will have the original copy of the ticket (as you probably only got the carbon copy of it!)

See a solicitor. Then not only will you pay a fine you will have to pay the solicitor too!

If the police cannot provide sufficient evidence to support what the court papers say then the case will be dismissed on the grounds of insufficient evidence.

hi i was in court 2 years ago for same offence if i was you you i would go to court and say absolutelty nothing to the guard cause now the gaurd can just step up and before he reads out the offence he can sorry your honourcan i correct this so wait and play on it best of luck!!!!!!! don't let him know his mistake and plead not guilt?
