I have just had an accident in my car?

I was coming out from a road onto a main road i wanted to turn right so pulled accross the road into the space in between the roads as I did I was hit from the right. I immediatly apologised and was in a bit of a state. As far as I can remember there was no car on the road when I pulled out although there is another side road to the immedate right of the road I think this is where she may have come from . when I phoned the insurance company I said I didn't think it was my fault and the woman tol me it would be if she wss on th raod first but I later phoned back and told them I was not taking responsibility as she may have not been on the road.

Any ideas what to do next or what the oucome might have been,

next time don't apologize. it makes it seem like it is your fault and the person you hit will tell the insurance company that.

since you don't really know where she came from, give them the best details you can but they will probably end up saying it was your fault.

WelshLad
Never take liability for the accident and apologise just swap details and report it to the insurance company. Fil out the details on the form and leave it to the insurance to sort it out.

You were at fault, plain and simple, and by apologising you have admitted as much at the scene. but thats no big issue. Your insurance will take over from here on.

Sorry to say but you don't get a vote on this decision, pal. Let your insurance adjuster work through it and if it doesn't go your way, oh well -- that's why they are called accidents, eh?

The way you describe it, it looks like what the insurance companies call "One Of Those Things". She may well have come out of the other turning, it's got the ring of truth about it - I can close my eyes right now and see it happening. Trouble is, it's your word against hers.

I reckon they'll share the cost - it's known in the insurance business as "knock for knock".

haha.. you dont have the option to choose whether or not an accident was your fault.

Your scenario sounds like ten thousand at-fault people i hear from every day.... " i didnt see a car coming!" or "It came out of nowhere!"

99% chance once they look at the map of where you were.. they will realize that you failed to yield the right of way and you will be found at fault.

I know it's a bit late now, but for future reference never accept responsibility, even verbally. Easy to say, I know, but that's the advice. From what you say, pulling across the road and you were hit from the side, it does sound like your fault, I'm afraid, but that's not up to us.

The thing to do is tell your insurers exactly what happened, complete with diagrams if you can, and let them sort it out. That's what they're for. They'll send you paperwork to complete, just do it as accurately and truthfully as you can, and it'll go from there.

In the UK you only need to stop & provide your name and address, and that of the car's owner if it isn't you, together with the registration number. By the sound of it you've done that so there's no need for the police to be involved, therefore no "police report" to be obtained.

sounds like it may of been your fault, a car doesn't appear from no where, u was pulling out so should of been aware of things around u, easy mistake just learn from it

tricky one, be care full as to what you say. most phone calls to an insurance company are recorded. be sure of what you say and stick to it because insurance companies will do whatever they can to get out of paying up. its sound like they may have pulled out as you were doing the same if not before>> they must have if they got to hit you in the time you were pulling out, ie. they must have already been on the road. were there any witnesses to back you up?

You don't have the option to choose responsibility. You pulled into the other person's right of way, whether you saw them or not.

The insurance company hears this crap all the time. No one wants to be at fault but you clearly are.

They will pay the claim.

Relax
We have insurance to cover us for an accident
Take your car to a reputable repair garage get an estimate and send it to your insurers.
Just fill in the claim form as you remember what happend.
Its not your decision as to who if anybody was at fault.
If you feel stongly that it wasn't your fault - make it clear on your claim form. You are only fighting for your no claims bonus.

Never EVER admit guilt or accept responsibility in a car accident at the scene of the accident. I don't care if you saw you ran the red light and hit the old lady in the crosswalk. The insurance co and/or police report will determine fault.

me
it is very hard to understand what happened in the accident. your description has to be detailed to the point someone reading it can draw a picture of the accident scene. your insurance company is going to get recorded statements from all parties involved, obtain the police report, and possibly do a scene investigation. your insurance company will at that point make a liability decision. whether you feel you are at fault or not does not matter. the facts of the loss is what matters and that is what your insurance company is going to based their decision on. not much you can do but let your insurance company complete the necessary steps and settle the claim. just worry about getting your vehicle repairs.

The insurance company will review the police report, take a statement from both drivers, and make a decision. If you disagree you can try to dispute but you have a slim chance of winning.
From what you have written, it looks like you are mostly at fault for the accident. Whenever you make a turn, it is your responsibility to check if the coast is clear. Drivers driving straight have the right of way. It looks like you failed to yield right of way to the other driver.
You dont really have a choice of whether or not you want to accept responsibility. The insurance companies will decide if you are responsible.

SIR GOLFALOT
Write down everything you remember, in the sequnece that it happened... you will need it later. Let someone else (police) make the determination of fault after reviewing the evidence. Do not admit fault, now.
