I was struck by a drunk driver, I have liability and uninsured motorist coverage. the drunk driver has no insurance, will gap pay anything?

Gap insurance will pay the difference between what one gets for a totaled vehicle and the amount they owe on the vehicle. It is not insurance that will cover one in an accident. In most (USA) states, (not all), uninsured motorist coverage only covers bodily injury and not (as many believe) the cost to repair a vehicle or pay for property damage. You need to contact your insurance company to see how to proceed. I'm betting, you have no coverages and will have to sue if you want to recover. |

Since you have uninsured motorist insurance your insurance company will cover you and they will then go after the drunk. It's collision insurance against the stupid people in the world. If you were hurt i.e. needed medical care you need to pay for you will need an lawyer because the insurance company will only go after their losses, not yours. Remember, the lawyer will cost you maybe more than your damages so don't go in blindly. |
