Unfortunately, you are going to be held liable to pay his insurance company. If you already paid him cash, and he has also filed a separate insurance claim, then he certainly is committing fraud. If you have any type of proof that you paid out of pocket (hopefully, you wrote a check and this may be sufficient proof), then you may be able to get the insurance company off of your back if you tell them to go after him for the payment. If they won't budge and continue to ask for payment, you minus well just hand it over and take this as a hard lesson. However, if it was a large sum of money, you may want to contact a lawyer to help you, but the cost of hiring a lawyer most likely will outweigh the money you are to pay back. Just be persistant, show as much proof as you can, and if you end up paying the money back, try to take him to small claims court to reimburse you as he has financial gain in this situation. |

if you did not get a receipt from the guy or he will tell them that you paid him cash your probably going to pay again. any reason you did not turn it in to your insurance in the first place |

Don't ever give cash payments in that situation. The only way out of your situation is likely to be a court battle.
Oh, and get car insurance for yourself. |

talk to his insurance company. He commited fraud. However, since you probably did not get a signed receipt from him.... and probably was not documented by a police agency.... you cant prove your case... and in the end.... you'll have to pay. |
