I hit a car from behind.... who then hit the car in front of it from behind?

I know the car I hit was my fault, but should I have to pay to fix BOTH vehicles. the car i hit should have gotten a ticket for hitting THAT car from behind right? It was obviously tooo close as well. UGH the cop argued it was my fault. I have to go to court for this.... is there any chance I can win this argument or is it all my fault?

If the other driver was stopped and you forced him into the vehicle in front of him, you are responsible for the damage to both vehicles. How will you prove that the vehicle in front of you was stopped too close to the vehicle in front of him?

Sorry to say but it is your fault no matter how you look at it. The argument is that the other car would not have hit the car in front if you hadn't hit the car. I have hit and have been hit.

Nope, your fault as u caused the entire motion of the accident.

People stopped in traffic aren't at fault for being pushed into others.

Definitely your fault. Obviously if you wouldn't have hit the first car they wouldn't have hit the car in front of them.

Not likely. The standards for following "too close" do not include having somebody shoving you from behind.

It is who caused the whole accident (the fault).

It's your fault, the two cars would not have collided if you hadn't hit the vehicle in front of you... Sorry. Hopefully you have a decent amount of Property Damage coverage to cover the repairs for the other vehicles and enough Bodily Injury if anyone was hurt.

I was involved in a VERY similar accident a few years ago. The car ahead of me stopped to turn, I stopped behind them, but the car behind me didn't stop and they hit me, causing me to hit the car in front of me. The car behind me paid for my car and, as far as I know, they pid for the car ahead of me too. I didn't pay for anyone's car, because I wouldn't have hit them if the car behind me hadn't hit me. Does that make sense? If they were already stopped it's your fault they hit the first car, not theirs.

How on earth do you not know your 100% at fault?

Your telling me every car has to maintain a distance from the car in front of them SO FAR that if they are rearended at a stop they wont hit the next car? thats ridiculous. How far would that even be? Even if this was a law you have no proof they were too close.

The two cars were at a stop and YOU rearended the first vehicle pushing it into the second vehicle. There would have been no collision if you didnt come along.

Your insurance company will pay for both vehicles damages and there is no way under the sun your getting out of fault/the ticket.

You or your insurance company owe for both cars ahead of you.

The car in front of you was not too close as long as they stopped without hitting the car in front of them.

I get tired of writing this here but, If the cars in front of you were stopped there is no law that says you have to stop a certain distance behind the car in front of you at a stop light or stop sign. Imagine, if you will, cars at a stop spaced out at 5 to 15 feet behind the one in front of them. Talk about traffic snarls during rush hour. I'm still waiting for somebody,anybody to provide a copy of any law on this issue.

Following too close is only an issue for moving cars, but even then you are at-fault for both cars, as long as the car in front of you stopped without hitting the lead car.

Sorry, but you will not win this argument and it is a waste of everybodies time for you to try. I hope you have liability insurance to cover this.

They may decide that you are not entirely at fault, but undoubtedly it is the majority your fault since had you not hit the first car it would not have hit the other car, whether it was too close or not. Therefore, your insurance will still be liable to pay the brunt of the costs for that other cars repair.

When ever you hit someone from behind, you are at fault. If that car hits someone else from behind, the car hit can claim against the car that hit them. They in turn, just add that claim to the claim against you as you started the chain reaction. Sometimes, in some states, the second or third or more person (insurance) just files the claim against the original at fault driver. That way it saves a lot of time, confusion, paperwork, etc.
Slow down next time, drive with plenty of space between you and car ahead and always try to have an "escape" route planned in the event the car in front suddenly slows or stops for what ever reason. It's called Defensive Driving and I recommend a course be taken.

It depends on how close the other cars were.

It is your fault through the laws of physics.

However, if you have evidence to prove that the other car was too close, you can win the case.

I suggest you talk to an attorney asap that handles traffic.

Go to your phone book. Call your local (usually county) bar association. Ask them if they have an "Attorney Referral Service" and/or ask for names of attorneys that handle traffic cases.

Talk to the attorney #1 first thing about how your matter will be paid.
