i was in a collision a few years ago, totally my fault. hit a lady head on. i was served with papers saying she was trying to sue me fo $750,000. keep in touch with your insurance company, they will be handling it from here. she ended up settling out of court for $30,000, paid by my insurance company. i was told that the amount was about the average settlement. that'll probably be the case if you were at fault. as long as you have insurance coverage, you'll be all set, that's why we get insurance. no need to panic, it's out of your hands at this point. |

Ask your claims adjuster, they'll have the most details on your specific claim. Your insurance is likely to pay out on these things, hers might for some things as well, it depends a lot on who is at fault and what coverages you have/what coverages have already been exhausted.

First of all, don't listen to Amir. If you claim there were witnesses, and you didn't hit her hard (and it's a lie)... you will get in trouble since she's also going to tell her insurance company what happened and they will know from that if you makeup witnesses. Also they can tell by the car damages whose fault the accident is so trying to say it wasn't your fault is useless also. If you lie to the insurance company you can be charged with fraud so it's not worth getting in major trouble over something that's really just an accident.
In terms of her whiplash, she may or may not get a lawyer. If she does, the insurance companies will likely settle it between them and chances are it won't need to go to court. The good news is insurance will likely take care of everything. The bad news is your premiums will probably go up and stay higher for a few years.
I got rear-ended at a stop light and it wasn't even at a high speed. I suffered whiplash for weeks so imagine how she feels right now. Probably worse than you. Consider yourself lucky that no one was more seriously hurt and just let insurance handle it. |
