i hit the person but the cop file the report as the other person is at fault because i had the right of way. the case paper says 500 in damages.. i also sufer from back pain can i get more money for pain and suffering.

the person was crossing ongoing traffic to get to the opposite side of the road...i break as hard as i could but the person stop dead in front of me..the damages are not bad. the person did not have the right of way so there at fault. my insurance just canceled in h=january and i have not renued it yet. no money you know.? i have upper back pain..and scrathes on my bumper will there insurance pay for the damage.

If the other person is at fault then their insurance company is liable. The fact you have no insurance does not matter. |

You are lucky you are not being sued. You are at fault it is against the law for you to be driving without insurance. |

You can file a claim but expect to get a ticket for no insurance. The other person can get a lawyer and pursue this, just because the cop said it was no fault doesn't mean you still can not get sued. Nor does it mean that what the cop wrote in the report, is going to stand up in court. Most insurance companies pursue. It would have to go to court, for the final decision. |

I think that you can file a claim against the other drivers insurance company .. you should go to the hosp and the other person has to pay that as well .. well their insurance company has too... You should consult a lawyer for some other advice. |

Well sir, it depends. You never told us where you are. In some states, driving without insurance also means you can't collect on damages regardless of fault. Other states you can. You can certainly contact the other person's insurance company, and as soon as you do they will want your information. When they find find out you are uninsured I'm sure they will want to argue that you should not have been driving at all, and if you hadn't been, there would be no accident, therefore they won't pay.
Pain and suffering is a slippery term. If you claim any amount for it, you will have to justify it. Can you? Remember, the other party has an insurance company with a load of attorneys ready to help him. What do you have?
So, to answer. Can you file a claim? Yes, you can.
Will you prevail? There is the real question. |

No, This happened to a friend of mine. He tried to counter sue, tried getting a lawyer. Nothing worked. He had to pay out of pocket and plus got a slap on the wrist for lacking the insurance documentation. Go to SafeAuto and get some insurance stat. |
