I drove my roommates car and totaled it i was at fault and i only have liability insurance for own vehicle and my insurance said they wont pay for other vehicle my roommate had colison insurance on his policy so my roommates car is taken care of but the other vehicle was damaged pretty bad my roommates insurance just sent a letter saying a claim was made on the vehicle where i the driver was not listed on his policy (my insurance would not pay so i filed claim through his he has western general) even though i lived in the same residence and they said they will cancel his policy in 30 days if he does not fill out a form to add or exclude me from his policy well he told me strait off hes never going to let me drive his car anymore but does he need to add me to his policy if he is never going to let me drive again? and if he does add me to his policy now will his insurance cover the accident i was already in
Help please yeah i screwd up big time, should add or exclude me from his policy?

Tough, you're going to have to pay for the other car's damage. You cannot backdate cover. Undoubtedly he will exclude you from his insurance. |

well if your roommates are going to cover the damage to his car, they should also be covering damage to the other parties car. its very strange they will pay only part of a claim. he has full coverage and that's why he has it. they may be denying claim since you live in the same home, but are not on his policy, however, this is not an unusual thing since you are roommates. it would be different if you were a married couple. i think i would be questioning this with his company. since he will NEVER let you drive his car again, i would have him exclude form his policy. that way if you ever do drive and have an accident, the company can and will deny the claim. |

I don't know the answer but insurances vary from state-to-state so you should probably let everyone know what state you're in.
Beyond that, it sounds to me like you may need to consult a lawyer.
In Michigan we have 'no-fault' insurance so it doesn't really matter who is at fault in fender-benders. The vehicle's owner's insurance covers damage to their vehicle. You can file a 'mini-tort' lawsuit here for something like $400, which helps to recoup the cost of deductibles so if you're in MI I would at the very least expect to get sued in a mini-tort. |
