Not entirely sure from your question whether you have been summonsed in your own right for an offence or if you have been summonsed as a witness in re a case of uninsured driving against your bf...
The car was not insured in the scenario you give above. Your premium would have been determined by the people who would be driving - Obviously insurers would charge SIGNIFICANTLY more for a policy to cover an unqualified driver, and if you did not realise this you have to be regarded as naive beyond belief.
He, as an uninsured driver is looking at an absolute minimum of 6 points and 200 quid, probably more as they have elected not to proceed through fixed penalty. If you are being charged seperately with another offense, such as allowing someone to drive your car uninsured you should bank on similar penalties applying.
Sorry, but no way was that remotely okay to do.... |

If he was driving with your permission you could be charged with aiding and abetting an uninsured driver to drive. This may well lead to a six month ban.
It all depends on the permission thing - if your boyfriend took your car without your permission, he is guilty of car theft and you will get off. |

That's your stupid fault then isn't it. It's people like you who drive up the cost of insurance premiums for the rest of us. |

I'm afraid your in abit of trouble here, the offence that your going to be charged with is 'using a vehicle uninsured against third party risks' (Code IN14, causing or permitting) this carries 6 to 8 penalty points and a fine of upto £1000. He will also be charged with the same offence, but his offence code will be IN10.
The problem that he has (and maybe you) is that if you collect 6 or more points within 2 years of passing you driving test you will lose your licence, get a years ban and have to retake both your theory and practical tests, not to bad for him because he hasn't done a driving test yet, but it could spoil your day!
The only way out would have been to claim that he was using the vehicle without your permission, very hard todo if you were in the car when he got stopped, and probably abit late, since I would guess that the police contacted you when they stopped him to inform you he was using your car, and you probably had to go and collect it from where the police stopped it, or possibly the seizure yard. The other problem with claiming this is that he will be charged with 'taking and driving away', as well as the insurance and licence offences, mean prison becomes and option.
Sorry, I know it all sounds abit bleak but at least you know now, if you want my advice admit giving him the keys, take whats coming to you and treat it as a lesson!
All the best |

you will probably get 3 points on your licence a fine and you will be banned from your insurer and probably most of them, so prepare yourself to be spending lots of money, on a new insurance policy,if you can find one.
honestly you should have known better!!!! |

Guilty of "aiding and abetting" driving uninsured. Same penalty as driving uninsured. Points, Fine, Lucky we don't cut bits of you off! |

You say you've been summonsed, but then you say you don't have to go to court - it's one or the other, which is it?
Reading between the lines, your boyfriend has been summonsed to court for driving without insurance and that is likely to give him 6 - 8 points plus a hefty fine. If you HAVE been summonsed too, it would be for "aiding, abetting, counselling or procuring" the offence and the same penalties apply. The Courts take a dim view of insurance offences these days I'm afraid. |

Presumably you are being summoned for allowing an uninsured driver to drive your car.
You will probably be fined and could possibly be banned from driving.
You should plead guilty and explain that you did not realise your insurance did not apply - if the court are satisfied that this is true the fine will be less than if they believe that you were aware you were breaking the law. |

I assume you were stopped for something else otherwise how can you be summoned? You are rarely stopped for nothing.
A provisional licence holder can drive a car providing that there is a full licence holder sitting with them. However, some insurance companies won't insure provisional holders on a fully comp policy. |

Why have you be summoned?? |

when you loan your vehicle, you loan your insurance. if he had an accident , the company will add him to your policy, if the accident was his fault. |
